im sorry to use those types of words on here guysm but this is just unforgivable,

Re: RIP my only son
Tim, I just stumbled across this tread this morning. I had previously followed and enjoyed your father/son project tread, but had no idea that anything like this had occured. As a father and grandfather a few years older then you, I can't even imagine the loss you must feel. It is certainly a parent's worst nightmare to outlive their child. It sounds like Alex was a very special young man. You have so many things to be very proud of him.I am truly sorry for your loss. You and your family are in my prayers. Charles

Gentlemen, I deeply appreciate all of your sentiments. It is of great comfort to me that you all cared enough to post here.
I do not refuse friend requests on Facebook... just tell me that you are a third genner in a message along with the friend request.
But you have to spell my name right, LOL. To my knowledge, I am the only Tim Ernandes on facebook.

I read both the first post, and your explanation of the events as they occurred. Let me just say you are a strong person for sharing the story of the events. Best Wishes to you and your family.

A hearing was held yesterday, and the defense is focusing on "mitigating the punishment". The good news is that where I live, there is a 'no nonsense' approach to jurisprudence.

This boy has been charged with Capital Murder. If convicted on that charge, there are two sentencing options: death, and life in prison with no possibility of release.

I cannot believe what I have just read, im in shock. First, I want to send out my condolences to you and your family. Second, It killed me to know that scum like that kid exist on this earth, but am really happy that he will get life or death.
Lastly, I want to say that it is very appearant what a great son you had with him helping/protecting that girl, good morals, and obviously smart which is not often seen these day. That is a testament to how he was raised. You and your wife raised an amazing man.
Again, sorry for your loss.

Re: RIP my only son
It's over. We were called by the prosecutor on Tuesday to set up a meeting for later that afternoon.
We were informed that the defense had offered a plea deal. They were willing to plead guilty to Capital Murder, guilty to murder with a firearm, and no contest to the robbery charge. In exchange for that, they wanted the death penalty off the table.
Although many felt that this kid deserved to die for what he did, we also realize that the odds were (because of the way the law is written) against his receiving that sentence. Then there is the matter of appeals, overturning a conviction, and reversal of decisions. Since this kid looks very young and fragile, it is possible that with a sympathetic jury, he might have gotten a lighter sentence.
Also, we realize that vengeance is not ours, and will not bring our son back. Since this would close the matter finally, once and for all, we agreed to the deal.
In a hearing the next day, the judge found him guilty on all counts, and sentenced him to LIFE for the murder (there is no parole or time off for good behaviour), plus 3 more years for committing a murder with a firearm, plus 50 more years for the robbery. So he got a total of LIFE + 53 years.
He is now being transferred to a maximum security prison where he will be confined for 23 hours per day in a concrete cell. No arts and crafts, no cable TV, no weightlifting, no studying for a law degree in the prison library. We have been told that he could have no worse life than the one that is waiting for him now.
What appeals to me most is that this is the most likely sentence that he would have received, if everything went our way... and it can never be appealed or changed for any reason. It is done.
Also, this meant that I would not have to testify (I was subpoenaed), and also the girl involved, who is now an emotional cripple, also will not have to testify. As soon as I can get together with the people in the sheriff's office, I will get all of his personal belongings back, including his rifles and the keys to his Firebird.

This is good news to hear Tim, I have always felt that the sentence you described is the best possible sentaence because you are forced to live out the rest of your days knowing the only reason you will never see the world again is your own fault.

Good to hear this under the terrible circumstances. I can no way understand the grief you must feel, and as the father of a 22 yr old son, I hope I never have to of course. My deepest sympathy to you and your family for this horrible loss. I would like offer my help in restoring his car if the day comes you choose to do so. I dont know if you are considering this or leaving it the way he had it. If theres anything you need for those cars please let me know and I will be more than happy to donate the parts to this cause. Please, just let me know if theres anything i can to to help.
Take care

Sometimes a plea agreement is the lesser of two evils. Having effectively blocking Alex's murderer from exhausting the court system with endless appeals is a great accomplishment. I believe that Alex would be proud of your strength and resolution. At least you can rest assured that his killer will never again walk as a free man.
You and your family are in our prayers. When one looses a child, it is never over.

I'm glad to hear that you and your family have passed this point. It's hard to heal with so much unresolved and constantly fearing that justice may be avoided. Undoubtedly God will continue to strengthen you if you continue to look to him. Forgiveness is an elusive creature but will help you more than you may even realize is needed. God Bless You Brother.

Thanks very much for the kind words. Unfortunately, the killer has shown absolutely no remorse, and indeed seems quite proud of what he did. He offered no statement or apology to anyone, including his own family. It's pretty sad and disturbing, but it is what it is. He will be judged by a much higher authority.

He isn't the one I'm concerned about benefiting from it. God's word says much about the subject. I hope that you can forgive him for your own good. He may not deserve it but you do, and so do those you love that are affected by how his actions have changed or affected you. Whether or not you find forgiveness may very well be pivotal in how much joy you and yours have in your life. Bitterness is a cruel and often invisible tool used by satan to steer those he can't otherwise get to. I've seen it destroy people and their families.
Turn it over to Him.
Turn it over to Him.

God has a plan and knows the end, from the beginning of it.(We don't even know his plan). Alex has touched many peoples lives, and in a good way. Not the way we would have hoped, as his death at such a young age is horrible.
Look how it brought several groups of people together for his cause. Some he never even knew.
There are people that still care about good. I see that Alex has brought it out in many. From what I have read, Alex was an outstanding young man himself.
Take care man, as I know today is special in your heart, and in the lives of so many people and for reasons we dont even know.

well...I almost don't know what to say.... I cannot believe that the guy has no remorse; I'm glad to see he got life in prison; guess he will have a long time to think about what he did. It won't bring your son back though, and, for that, I am truly sorry. My condolenses. Alex, R.I.P.

I haven't been on third gen long, but I only live about 30 miles from Moneta, I'm surprised I didn't hear about your sons passing.
You have my condolences, I know this thread is a year old, but I saw it, and couldn't just read it without saying something. There is too much hate in this world, I see so much of it. I really don't know what else to say, but you have my condolences.

Padre nuestro, que estás en el cielo, santificado sea tu nombre; venga a nosotros tu reino; hágase tu voluntad en la tierra como en el cielo. Reading this thread is the closest I've come to tears in over twenty years. Not at family funerals, not at my own dad's funeral. I simply can't imagine the pain at loosing one of my son's though. Sorry I didn't see this until now, I usually don't scroll this far down the board... For what it's worth, please accept my sincere beleted condolences on your loss. I cannot imagine, and hope I never have to deal with, the amount of pain and anguish this must have been, and is still, putting you through.

I was not on here over a year ago, but i feel i should send my condolences and let you know people are still thinking about you and your son. im a college student about the age of your son, and was reading this today in my summer class and i was really touched by it and couldnt understand what it must be like. my thoughts are with you over a year later and i wish you all the best in the future and the best with Alex's 'Bird.
