any loop holes to recovering a siezed car? for pre-arranged speed competition?? Im so pissed!

How did they seize it? Is it just an impound? I know a way to get a car out of a 30 day impound. Lets hear the story!

it was a 2 month sting.....so yeah its seized...they came and got me lastnight and got my car too

im kinda scared to post any details about what happend to me personally but its ll over the NC forums....LS1tech, carolinarides, autosportnc....just to name a few.

im sorry to hear that, i know you had a lot of problems just getting the car together and now this. Not to preach, and i dont know the details, but this is exactly why you dont get involved in street racing.

the post on ls1tech is a bit scary, not a good situation for people whos car got impounded.

well i dont think they know about this site.....yeah they came and got me 2 weeks after the so called date...which is BS!......I wasnt there....they came in my house and jerked me outta my own home..claiming they could do that cause they had a warrant..I can see if it was for a violent Felony but not a driving mesdomeanor....I mean come on!...
so yeah im claiming I wasnt there....I think somebody just mentioned my car cause there were either jelous or cause they know it was fast...and they made the whole thing up just because I cruise there sometimes....i havent been there in months.

and on my warrant it states "with another vehicle" (unknown) so if they were to have caught me on film like they are claiming then why did it state the other car? it should have! i was told.

my car has been seized and im pissed cause I have no clue if I can get it back or not...and the court date is not til January sometime.

hey man calm down im not point fingers, assuming, or accusing here just a statement, i may have been vague, but i was referring to organized street racing, i will admit, i've streetlight raced a couple times, and a chance encounter on a backroad or two.

If you know you are innocent of what they are accusing you of i wouldn't sweat it too bad, if this "tape" doesnt exist, what do they have on you? if its nothing you'll be ok. I cant imagine how you feel over this, the worst i've ever done was roll my car into a guardrail and scrapped up the paint, and i was devastated over it, I can imagine how i would feel if someone came and just took my car, and accused me of things that are not true. I really hope things work out for you. Do you have a lawyer?

Wow that sounds like some crap, all can say is I would be pissed too.

Make sure you get a lawyer. I don't see them having a case unless they have your car on video with the plate visible. If they do, and you're racing, you're pretty screwed.

I know here in ohio they cant give you a street racing ticket with out catching both cars.

Not sure about all the other states, but I do know sometime ago,
California started sezing and crushing street racers cars.

the more important thing is nothings gonna happen to the car until you get convicted, so like everyone say get a layer and fight and if you win they are obligated to give you back your car. They may try to give you trouble if it's not street legal but thats BS if you were sitting at home and your car was parked

no info yet.......They still have my car...they have had it since 11/23/08 so its just sitting at the siezure lot...I tried to go get some stuff left in it but then wont even let me see the car...so I cut threw the woods and came in from the backside and took pictures....just to make sure it was there..
Im pissed about all of it....the car has been out in the weather and out of the garage since then....has never been out this long...

The DA set "Discovery" dates for next week....so I will know what kind of evidence they have on me by the end of next week. Then after seeing that I am to make the decision to fight it in court OR plead and plead guilty..WHICH IM NOT DOING!

I really dont car what they do..I just want to car back.

when I went to court last month...they had a state machanic there and was trying to say headers and bolts ons are illegal....HAHA...yeah right

They are making such I big deal about the whole thing...set a private court room for all of us....with not just an assistant DA but the ELECTED DA was there...and nothing in there but ALL the troopers involved, lawyers and 1 judge to handle ALL the cases..it was a big mess!

yeah i got a lawyer....said they have to have ME, my car, the tag all at the time of the so called race.....they have to prove it was me in the car.....and he said he doesnt car about some Audio BS...so hopefully I can get it back...but if I do....im thinking they will make me put it back to legal.....but it is street legal other than no cats....which they have already let me know...

my car was setup for show and go...so when they popped the hood on mine..they were like...WHA!!!!!!!...lol....nothing like all the other crap they took.....only other car worth anything was a 10.08 cobra

help me out here......I would really like to read up on the laws and how they can prove "pre-arranged" which is the only charge that can keep my car from what I think I know

man that sucks but they must have some evidence on you because im pretty sure they cant just take your car on someones word or a hunch. unless im not getting the full story here

that sucks man... cops said they were gonna tow my car cuz they had eye witnesses unless i admitted it, which i did, and got to drive away with a 300 dollar fine and 20 day loss of license. I dont think they could have been any more reasonable than that... which is rare to hear these days. But talk to your lawyer some more and just be lk hey i think i deserve to know whats goin on here... let me handle it is a little unprofessional.

damn thats insane... makes me want to actually install the toggle switch for my brake lights and license plate light...

oh yeah I hear ya!....I asked about that months and months ago...but no one would tell me how to do it...would come in very handy at a time like that.

I wanted a toggle switch so I could turn off just the rear lights even when using the brakes but keep the fronts working until the toggle was turned back on...

hell ya they did. I was watching the two civics race when the cops blocked every entrance to where they were racing and got their cars towed. 2 weeks later the same cars were on the news being crushed. The same cars i watched race. It suck to see that or even imagining my Z28 being in the crusher. After that BS i never went street racing again. Its not worth it.

Most headers are illegal. Not only is your car not having cat's illegal, but I will bet money your headers are too, just like almost everyone elses.
What nobody thinks about cause of states like IA, KS, OH, that don't do inspections is that just cause the state may not have laws or enforce laws like having a cat.
It is still a federal law that any street driven vehical cannot have any emissions removed.
So buy putting in headers and taking the air system out of the car cause your either to cheep to buy the headers that have them, or it looks to ugly, you are putting illegal headers on your car.

I am also going to add this. You keep saying how you did nothing and it's all ricers that are the cause of this.
If you did nothing why did the police take your car? You were saying something about them having to have you, the car, and the plate, and prove you were driving to do anything.
I don't see how they would be like oh look a Camaro looks like the one we saw racing let's impound it.
Even if you were just there you had to do something. Also just being there can get you in trouble too, cause you are still participating.

I have NO problem with illegal street racers having their cars impounded... If you truly weren't there and did nothing wrong, I sure hope you get your car back.

pre-arranged keeps my car....spontanious racing doesnt! and it would be REALLY HARD to prove pre-arranged

If your lawyer is doing something for you, he has the right to request the same evidence that the prosecutor has. Ask him to review the evidence against you and tell you what's going on.
An attorney is there to untie your hands, not to tell you that he is handling it. Ask him what your options are and what he expects to happen. Do you know what kind of a charge it is that you are charged with, misdemeanor, felony, etc.? With lawyers you often times get what you pay for. I suggest that your lawyer either gives you a straight answer about the law and what you are dealing with, or you go shopping for a new lawyer. Hire the one that seems to know the most about what's going on, and that can give you an idea of what to expect.

I don't encourage street racing by any means. There are way too many dumb kids that will do anything in order to win a race. But the way I see it is, young people make mistakes and sometimes they should be given a second chance. I bet you that if you were to get your car back, you probably will never race it on the street again.

I have been charged with 1 count of Pre-arranged speed competition and 1 count of wreckless driving both class 1 misdemeanors....

Here is my state there is no "Discovery" on misdemeanor cases...only felonies...the DA is allowing "discovery" as a privilege cause so many are charged....the guy you see his face has 9 counts.

I know alot about whats going on and what you guys have seen...but I wont say S*hit on here..........till i know what going on and what exactly they have....I'll find out next week..then it will be a whole new ballgame.

Hopefully I will get my car back....like I said they can charge me with whatever and I'll even do time over it...just give me my car back...

if I was to get charged with the max.....that would be like almost $40,000 + for lose of license, insurance, fees, fines, etc.....I dont care if street racing is legal or not....but that would be totally rediculous

there are so many other worse crimes out there that allow you to keep your investments.

yeah ....i know alittle more about whats going on...I wasnt allowed in with my attorney to see the evidence..which was kind of stupid cause the attorney has no clue what he is looking at ...will the DA and the undercovers narrating what he is looking at is f*cked up....but whatever!!!!

I hope youre not using a public pretender... I learned that lesson the hard way. Just dont plead guilty man, theyll keep coming at you with better deals. And if you do have a PD hell convince you that theyre "good" but if you truly KNOW you werent racing fight it to the end. You have the advantage of not being in custody, in which you can hire a better lawyer. Sounds like your attorney or whatever is working for the DA. I was in a situation where I was in custody for a much different crime and all I could get was a public pretender, long story short he convinced me to sign a felony plea bargain when I didnt have to, but Im sure he gets more $ from it. Lucky for me I got a pretty sweet deal and on the 18th I get my charge expunged. Just remember, to them its guilty until proven innocent and if they got you on video, you NEED to get a good lawyer to get your car back. Doing time can ALWAYS be substituted for fines and such.

The cases went to court late August...the 26th I think. Everyone was found guilty....they took the plea bargain. I on the other hand was 1 of only 2 people that took it to trail and I was reamed a good one! WAY WORSE than what anyone got...Cause of course I was found guilty. There was no way to excape the guilty verdict...it was just to political and to publicized to be found not guilty. I appealed! and will take it in front of a jury. "beyond a reasonable doubt" lets see!!!
They HAVE NO EVIDENCE ON ME after hearing what their testimony was.

Wow, that is such BS. I have had 2 street racing tickets, and haven't had to go through any of that ****.

I got what you call a good rail roading, *ss reaming, banged in the butt DRY!

it was all BS!.....the plea they offered was exactly what everyone got.
Forfeit your car, loss of license for 3 years and after 18 months a letter would be sent to DMV to allow to get them back, $500 and 30 days suspended...some got community service.
SO WHY NOT FIGHT IT!...their way you lose your car for sure!!!!!
I dont really know what they gave me when they found me guilty cause i wasnt paying attention. Alls I know is that it had an active jail sentence cause of my record and I was like OH HELL NO!...LOL so me and my witness both got active time cause they didnt believe him and had to post an appeals bond. THe judge didnt like me for **** cause i plead not guilty and took it to trial and he wasnt having any of that....

Like I said, it was way to polictical and publicized and there was no way anyone was gonna get out of it.

I wanna see a jury find me guilty with no HARD evidence. My face , my car, my tag...ALL of it together at the time of the so called race. THey dont have that. SO if the jury does it job they cant convict it. I hope atleast. LIke ive been saying the whole time, i wasnt there and didnt have a clue any of it took place until after the fact.
