got a speeding ticket

finally got my first speeding ticket, but im curious on if i should fight it, the cop didnt clock me, wasnt on the same street i was on but heard me open it up, and admitted he doesnt even know how was i was going over, but this was in a graveyard area near my house. the ticket was for unreasonable speed and left of center when there arent any lines on the road i was on. advice?

I would go no contest, but base off what you said I think it'll should be easy to get rid of since he didn't clock you and theres actually no lines on the road. IMO

As a future cop, I will tell you, they "check" speed, not clock. If he did not check speed with equipment he/she is trained to use, then in court you are not "guilty beyond a reasonable doubt" as the law requires for a charge to stick. Hope that helps and good luck!

That really is "hear" say. Don't know the law where you live but I think in CA (and everywhere else?) at least the cop has to see you do what you're accused of. You could have missed a gear and been doing 30 in first or downshifting. Lots of things. How did he know you were left of center if he wasn't on the same street? As for that, I do that all the time because the roads are so bad around where I live that you need to avoid pot holes and assorted wild life all the time. Plus deep ditches and broken road edges.

If you got the time, fight it. An officer stopped me saying I was doing 45 in a 35. He didn't clock me. It was by observation. I sent back the ticket saying that I was going to court and waited for my date. Three months later they sent back the ticket saying they were not going to pursue it. they knew they didn't have a case.

It depends if the cop was trained to judge speed without the use of a radar gun. Certain cops are trained and can issue tickets although it can't be for a precise speed (which makes it a less serious violation).
If he has no training, in the state of NJ the ticket is null without radar.

In NYS if theres wrong info written on the ticket. like youre birth date. It becomes automatically invalid.

Must be nice to be able to fight those tickets.

I got a BS ticket for going 15 over when I was actually doing 3mph over. The ******** tried to tell me I was doing 65mph in a 35 and I laughed at him because I knew right then and there that he was simply pulling me over because I was a young guy in an old muscle car. ( Or maybe he was a Mustang fanboy? ) He then tried to tell me that he was " Cutting me a break " by only putting 15 over instead of the 25 he should have.

Went to fight it, cop didn't show up TWO separate times and I got continuances. When he finally DID show up, we said our sides of the story and the judge was basically like " k, heres your ticket, pay up "

Absolutely no hesitation or further questions.

So yea, I will go out of my way to avoid spending money in that city. That city is basically a dictatorship ( lived there from 1997-2012 ). They will do EVERYTHING that can to screw the little guy over.

I think the "break" giving a ticket for 15 over may be more for the cop. If it's over 15 over the limit I think it is classed as reckless driving and different rules apply that involve the cop doing more work. I got one going to work early on a Sunday morning. Didn't see the copy enter the freeway behind me but I was already too far away for him to clock me accurately. I was doing over 100 but he gave me a ticket for 70 (55 limit then). ie 15 over even though he knew it was really more. But that was when you could go to traffic school and not pay the ticket, just 10 bucks for the class and a nominal processing fee. I've been more vigilant since. Not slower just more vigilant.

you know it costs you MORE money to fight the ticket, right? It's not free. Oh, and Cops will take court days any day of the week if you choose to contest the ticket.. it just means a paid day to sit and do nothing for them.

You can probably get it dropped, but I still think it's not worth it.. especially if you need to take off work to do it. That means lost wages, and then court fees come into account..

I would ask a lawyer, Remember its not just the cost of the ticket but also higher insurance rates, It may seem stupid but one that specializes in trafic laws and works in that area is your best bet,and will know the prosecutor, Most of the time they make a deal and you get off free and clear. And those who have lawyers get to go first and not wait
Most traffic courts don't care if you are not guilty, they just want your money, And for anyone who ends up in court, Remember to be respectful and be nice, Don't go looking like a slob,but also not like you have a lot of money. If you are contesting the ticket with out a lawyer make sure you have what your going to say clearly written down before court. Make sure your facts are straight, If you have any witnesses bring them with you. Most police have video and audio in there cars now days, they record everything when interacting with someone they pull over, and it's date and time stamped, If they used this when you where ticketed then you have a legal right to it and to use it in your defense.

Always fight any ticket 100%..
never take a offer to drop to less of a charg. always fight.

most of the time the cops do a sloppy job. and you can beat them..
in this state they dont even show up in court. (they dont have to) they just read off the the cop wrights on the back of the ticket...anything you say will be on it..and alot of the time stuff you did not say will be to...lol

always say nothing at the time of the ticket..and fight in later on..it works.

know how to talk in court. and dont stumble with words.

(edit to add) been doing the hot rod thing for over 30+ years
to the guys who say just pay it i cost more....ill just say i have had over 27 tickets tossed out with a Not Committed
and over 20 with a Not Guilty and a few Dismissed
iv had to pay only 2 tickets in 20 years
and with no fines..there will be no court cost! dont let them chard you for getting no fines!
1. exrd tabs 5 years expired (away in the marines) came home and drove my car...lol
1. 46mph in a 35 $98 fine...just getting lazzy is all...lol this was easy to just pay. that was a half day of pay. and saved me a 40 mile drive..ea way

i can post my driving record....you would get a kick out of what i have had tossed out..

even if you go 1 mph over the limit your speeding and guilty...so never say anything at the time of the ticket!
always get a copy of the ticket the cop turns in..know what he is saying on the back of the ticket. this will do most of the work for you...trust me it works!!

Long story short, it really doesn't matter, Do you really want to be in the "eyes" of the cops. The more you push back and resist weather it's a ticket or anything, they see you as a problem...ONCE that happens, there your on there radar.. The last place you want to be, take it from me, pay the ticket, fall back into the shadows and don't draw attention to yourself... You **** them off (I know it bs), then they go out of there way to check up on you and "pay attention" to you and what your doing just waiting for you to do something wrong... That's not even to mention all the camera and surveillance all over EVERY city in America now a days... JMO, stay under the radar so they don't pay attention to you, and this time might have been wrong, but I'm sure you have opened her up from time to time like all of us.... Unfortunately it's the price we pay when we build high performance cars for everyday driving...

want to add. i also got a ticket one time.. the cop told me it sounded like i was speeding... as i went by her..she was inside a cop shop.. she waited by my car for 20 min till i came out from the store (with beer) to give me the ticket....yes it was tossed out for the fact..she cant go off of sound...lol
got 1 one time. also as i made a cops car windows shake..(his story)... to loud. it was dismissed by the judge as the cop had no way to measure the decibels. and i had over $1500 in receipts for my exhaust. lol 10 sec car on the street..the judge did not even want to see my recepts..nice guy too..

also if you install 1 or 2 cameras in your car (mine has 4) it go's a long way in stopping any payback any cops want to pull...remember always be nice polite..but dont talk to them..most of the time they will hang them self..

my set up has SD cards in them but also records to a hard drive i have under the back plastic.. sound is fantastic. mics inside and 1 on ea mirror out side.. (say hello..to my little friend!) i started that a few years ago...as it covers me for insurance..anybody checking out the car.. and bad cops...

you can get them off ebay for under $40 ea

Why lock up this thread, Maybe someone will need some advice later on and they wont have to start a new one Or others could tell there story of getting a ticket and what they did to get out of it,

On a personal note the best way to deal with a ticket is not to break the law in the first place, Drive under the limit and make others even the police mad because they can't speed

Having multiple police officers in my family, ALWAYS fight a ticket. I live in NYS, but I have been told to always fight it. They will work with you on taking of points, etc. I found that offering to pay in full if they remove the points seems to work. Its the points that get you in the end.

By the way, yesterday I just took my bird out for spin after replacing the ICM. I wanted to warm her up and get gas to see if my starting issue was resolved (it was with the new ICM). So I was as a gas station, playing metallica kind loud and filling up. Across the street is another gas station, and there was a sheriff car sitting there. So he drives over and parks in the same gas station I am in. LOL! I was being profiled for sure. No issues, I just left normally and went home. There are not many 3rd gens around anymore, and muscle cars are few and far between, even new ones. Bought back memories of when these cars were everywhere at one time.

If you look at my car and yes it's the car I drive most of the time being it's the only one I own, I drive below the posted limit, use my signals always, And I never get pulled over in it. Now I know some officers have gotten behind me and ran my plates, the car does attract a lot attention for it's ugly look and very choppy exhaust note, But still I have never bean pulled over or gotten a ticket in it.
When I started driving civil and under the posted limit I stopped getting tickets. And it hasn't bean easy driving a car that is fun to drive fast.
So do I believe if you drive civil and don't break any laws will I not get a ticket? Yes I do.
And the Rodney King reference was well over 10 years ago and now the police have to worry about us having cameras and video them,

all they do is try to clean up after. and collect revenue for the city they work for.. i dont race around the citys i have lived in.. they just see the car and here they come.. i just pull over even before they hit there lights...lol

my father was a cop for 25 years in Las Vegas NV. and i have alot of friends that are cops..they all say the same thing..hell ya ill pull ya over... i had highway patrol pull me over one time just to look at the car.. wanted me to wait for his buddy to get there he wanted to check out the car... then after they had me/asked me to light em up when i took off... and yes..yes i did..
not all cops are bad..just most

also just want to point out.. ya get to know when the cops are watchen ya..its a 6th sense sorta thing... i have never got a ticket for truly fu$%* off.. yes i have done it...ya bet your a$$ i have...but never in front of coppa coppa wana be crime stopper...

get the video cams in your cars.. it will save you money by getting you out of bad tickets..they work!
and if ya get a mouthy cop. it's even better. judges love mouthy cops...

i deal in alot of class 3 firearms (aka machine guns)& suppressors (aka silencers). about 98% of the cops who check out some of the firearms i have with me..when pulled over they dont even know what they are looking at...and none have ever asked to check out my paper work for the guns...they would not know what to look at anyway...lol but they all say the same thing...cool!.. they are Revenue Collectors.
