Hello Thirdgen. I'm sure many don't remember me. It's been a good 2-3 years since I have posted here. It's unfortunate that I must come back with such bad news. Here's the short version of the story...

This is what happens when underage girls drive. My brother was on his way to church when a 15 year old girl who did not even have a license drove into his oncoming lane. She was turning, and thinking SHE had the RIGHT OF WAY IN A TURN LANE, right as my brother went by her. There were no skid marks, meaning that he hit her at at least 45 MPH. It caused her SUV to do a complete 180 and bent her rear axil. The girl is getting many, many tickets including failure to yield, driving without a license, underage driving, and being a dumb @$$. Everybody is alright, just a little bit sore. Needless to say, the Camaro is totaled...

There SHOULDN'T be any reason to sue. According to our insurance (havn't been able to talk to her insurance) as long as she had permission from her parents to drive she is covered. Thankfully, she did. Her mom told her to drive and get their SUV inspected. Therefore, she SHOULD be covered by her parents' insurance.

I had a lot of money in that car and I'm losing all of it except for the speakers I replaced. Restored interior, completely reworked suspension, small engine details, and not to mention the time and blood put into it. The only thing good coming out of this is that he will finally be able to get a newer, far more reliable car (my brother isn't mechanically inclined).

man that sucks, i dont know how it is there. But if your underage you have to have a parent with you when your driving. So it seems the parents will be in trouble also if it's anything like ohio. But glad your brothers ok, camaro's can be replaced. Maybe he'll get another one as a toy. That's what they're made to do. Not just to look at and brag about. Although that is part of the fun. and rwdtech

Mistakes
 
My brother got a few of the facts wrong. The girl was 17 and the passenger was 15. I did not bend her rear axle. I gave her a flat tire and 2 banged up door.

I am sore on my neck and shoulders but no broken bones.

I am pissed off about the car.

No they just need to make the test to get licenses ALOT harder than it is. Make make a section on the test to see if you can handle a car correctly in rain/snow. People are crazy around here and will drive 60 mph on icy slick roads and then wonder why they cant stop as well as they did before. In germany ive heard the test is alot harder and they have to pay alot more to get the license.

I agree that it should be harder to get a license (and even a permit). If you can't pass the test on the first try, you should have to wait at least a year before you can try again. I could have passed that test when I was 8.

Last I heard, it cost between $2000-$3000 to get your license in Germany. Hopefully I'll have some good news tonight, for once.

no i'm not. i had a bad whiplash accident once (head-on), and to this day if i sleep even slightly crooked it will begin bothering me and hurt badly for a whole week. i did not know at the time that even after i recovered there would be residual pain. luckily i had good advisement at the time.

the point is, once you settle on an agreement, you cant come back 2 years from then and start complaining about your neck. this is the only chance you get for compensation of any current or future (even unforeseen) injuries due to the accident.

i am not condoning fraud at all, those people make me sick. but i think considering the good money we pay for insurance there is a time to receive some benefits and perhaps this situation is one of those.

SUE SUE SUE! is that all there is to this country anymore? I think sueing BS even if it is the persons fault unless you loose a leg or some other major injury its just the risk you take when you drive. everyone is so woried about howmuch they can sue for that you have to make shure ya dont scratch your *** in front of the wrong person!

I am really sorry to hear about your car, but sueing just is not the right way to go if the inshurance pays for the car/immediate injurys.

Sorry for your loss. I feel your pain all too well. I lost my camaro to a dumb female who said she sneezed and didn't see all the gridlock traffic in front of her.

I still cant have any fun driving cuz i spend all my time in fear of these stupid drivers that slam into thirdgens like its no big deal. IMO every thirdgen lost is a tragedy

Whoa. I think you guys misunderstood me. We would sue only if her insurance company DOES NOT pay for the damages. Also, we would only be sueing for the car, not for any injuries. We aren't trying to scam anybody or make a quick buck.

Update for those who care

Turns out the other car was NOT insured. But StateFarm said that they would cover our car under "no fault" and our rates would not go up (I love StateFarm :) ) The only thing we have to do is pay a $250 deductible that we should get back after the insurance company sues the party at fault to get their money back! Karma sure can bit you in the @$$ :lmao:

Unfortunately we are only getting 2800 for the car, minus $350 so we can keep the car with a salvaged title.

My dad and I decided to keep the car so we could continue our plans of restoring it to better than show room condition. Maybe in 6 years I'll post again to provide pictures of my pride and joy :rolleyes:
