There's the link that explains what originally happened.

So now the Tire shop takes my car down to the GM dealership and has them look at it. The tire shop never discloses the findings of the dealership to me, just says that they want to verify that what broke, was NOT broken before the accident.

Seemed fair enough, so I figured I'd give them a chance to check it out, I'd want the same opportunity. Well, I call and I call, I drop in, and the manager is never there (3 weeks go by). I finally get a hold of the guy on Wednesday of this week. He claims the car will be ready Friday, all paid for, all fixed, just pick it up. "Sorry for the delay, the dealership had to wait for a part to come in".....

Show up to the dealership, "It's ready to go" they say. "Oh, yeah, we drove it out there," they claim.

I get in it and....nothing. So I go back in and the mechanic who diagnosed it says, "Oh, you've got 3rd and 4th gears." (keep in mind we looked for this guy for a long, long time before I got in the car....I wanted to ask him a few questions.)

So I re-ran the scenario by him and he said that he found no corrolation between the transmission (which was fine) breaking and the car skidding violently off of the road due to a rim falling off.

He says there was minimal damage done to the car underneath, only a bolt scraped here and there....and the rotar was actually salvagable, but they replaced it anyhow.

He said, "It's obvious you weren't going very fast."

I then said, so if this wasn't broken before the accident, then how coudl I have been going slow, up a hill on a sharp turn in 3rd or 4th gear?

Everybody in the room, which was crowded by this time, was quiet.

I don't think he is trying to screw me over, I just don't think he had the whole scenario of what happened. ( I suspected the car woudn't be fixed, that's why I didn't even show up with another driver to drop me off!!!)

So he says, well it had a lot of miles on it....so what, it still worked without a hitch...

Anyhow, now to the point.

I am going to take the tire shop to small claims court provided that they refuse to fix the tranny. (It's at a trusted tranny shop at the moment).

I will give the OWNER, THIS TIME, the opportunity to step up and do what is right.

That's all I want---- fixed. If I go to court I will be filing for lost wages, perhaps a rental car, a new set of rims (the ones I purchased all have elongated bolt holes from loose lug nuts and are now faulty), of course the tranny, the little bit of body damage that was done to be repaired, and then the filing cost itself.

So, any suggestions?

I agree with you and takin them to court. Make them pay for everything. Get reciepts for everything that has to be replaced and for any amount of money you have to spend because of your accident. Get some estimates to have other shops fix the problems so you have some backing as to how much money you are asking for. Another member said in your other post that when they said they will fix everything "no charge" sounds like they are claiming responsibility. Sounds to me like they are backing out because they now realize just how FUBAR your car is. They messed up and should have to pay. These are supposed to be educated mechanics, thats why you paid them to do the job for you. If you can, find a judge that is a fellow camaro driver or at least a car guy Hope it is all turns out well for you. Post what happens in the case or what the turn out is.

Well, first of all, I really feel that too many court cases have really hurt everybody, but this is an instant where I feel it's needed.

There was previous damage done the body of the car, and I'm not going to ask for any of that to be repaired. I just want what actually was damaged during the accident to be repaired.

Well I have two friends that are auto shop owners. Another friend of mine owns a paint and body shop, so I'm sure I could call on a few favors here.

You're exactly right, they did claim reponsibility for the accident. Now that the damage is more extensive than they originally believed, they are shying away from their responsibilities, at least that's how it feels on my end.

Who knows, maybe they feel that the tranny was due to go at any moment, and it wasn't thier fault. Even if the tranny was on its last leg, which it wasn't, the accident pushed it over the edge!

So here's my other question........


I've taken the car to a local tranny shop. He's gonna check it out. I guess that there are 3 shafts (1-2, 3-4 and then one for 5-R)...at least that's what I've been told, I've never torn one apart and know nothing about transmissions.

So I have 3 and 4, it seems like 5th gear may be OK, but you have to engage the clutch to get into R, but once you're there, nothing happens.

To get into 1 or 2, you just put it there, no clutch needed. You can hear a little whine sound coming from the tranny when it is in 1, 2 or R and you rev the motor.

So estimates on fixing this?

consider yourself lucky that the shop is willing to fix your car. some companies would consider your vehicle a "total loss", and just pay you the book value of the car (around $1500) without attempting any repairs.
