My Jerk boss actually fired me today because I told him i was reading over the Empoyment Standards Act, after he basically accused me of stealing. To make a long story short. We had a old powersprayer at the shop, hasn't worked in over 3 years, sitting around roughting. I finally decided to tkae it home a fiddle wiht it. Keep in mind I am a close friend of the owners son, and the family in general. SO teh bosses duaghter in law sees me putting the washer in my van, I even wave to her. Next thing I know it is a big deal at the shop as to the where abouts of the power washer. Turns out the boss went and asked all the empoyee where the thing was, even though he knew I had it. He then come to me and asks me where it is... I tell him "it's at my house, I am trying to fix it." He reacts fine to it and syas he is going to fix it and wants me to bring it back, No problem I said. Turns out he knew I had it all along, Lied to me when he adsked where it was. He could have just sadi " Keiran why did you take that old powerwasher?" BUt he didn't. His daughter in law basically accuse me of stealing. The thing that really pisses me off though. I thought I knew these people better then that. We've been friend for over 10 years now. Hmm Just when you think you really knoiw someone, they pull this crap. OK to shorten this up. I confronted my boss thsi morning about this situation. He gives me crap saying you should have asked to take it home. Ok I can admitt it, maybe I shoud have. All I wanted was for my boss that he to made a mistake by misleading me and not just asking me why I took it home. He wouldn't do that and told me that it is considered stealing. I told him I was reading the Empolyment Standards Act, and he told me to get out! I said "Your firing me?" He said yeap. THe crap hit the fan then. And I told him I would see him in court. SHOUUU. Sorry everyone I had to get that off my chest.

What do you think? Honestly. I don't need any crappy smart *** advice here either, just the truth. Now I have to open my own 3rd gen shop or something. ANyway is anyone hiring in my area. if anyone can help it would be appreciated

You definitely should have asked before taking the equipment home.... but your boss really over reacted.

I don't really have any contacts in that line of work, but I immagine dealerships might pay well for someone with as much experience as you have. Maybe it's time to pursue that idea of starting your own company.

I don't know how hte jobs are in the industry.... Perhaps you can try searching a work website, but i'm not sure.

If it is infact difficult you can always go back and apoligize (even if you were right). I'm pretty sure your boss would re-hire you if you were professional about the situation (even if he is an *******)

Given the resources I would love to open my own business, I had small side projects during the last 5 years.. computer repair and sales etc but never had the means to make it the business to support my life.

I know I should have mentioned something to my boss about taking it, but I also thouohgt I was a friend, I've known the family longer then I 've worked for them. I really never thought that they would ever think that of me.. to steal from him. I may be alot of things...but not a Theif! ANd for him to insult me in that way, no appology will fix what he's done. Honestly, maybe talking to a loans manager is not a bad idea. They won't charge you anything to just sit down with them, and the worst that can happen is you get turned down for the loan.
Do you own your own home? Have any bonds/mutual funds? Anything of value that could be used as collateral?

It's the times like these in life, that you will realize when you're older, opportunity was knocking.
You can either start your own business, work your butt off as your own boss, or continue being on the recieving end of the crap that you just got.

BTW, that's total bullsh!t. Your boss should not have done that. If you have any ideas for petty revenge, I only live a few minutes away.

It might be tough to live without the steady income until your business shows a profit, but not as tough as still being an employee, and getting laid off/fired at 55.

Today may be a bleak day for you, but it may actually be the first day of a new chapter for you. Sometimes bad things happen for good reasons. Perhaps a new opportunity will pop up in the coming weeks or you may start your own business..... regardless, you will look back a year from now and thank the @sshole boss for what he did.
Years ago, I got fired (with my freind) because of something he did. I ended up working at Molson's for more $$ a week later. I worked there for 4 summers. As a student, good jobs were hard to come by, and that was the best. Today I still see the guy that fired me after all these years and laugh at him........ he opened a new opportunity for me and made me a wealthier student.
I mentioned in a post some weeks ago about needing polishing tips. If you decide to start your own business I will be glad to patronize your place. I have family in Niagara Falls and need another excuse to visit. I like what you did with the Prelude.

U.I. will pay you to start your own business, I was unemployed in the summer(maybe again, soon ) , anyway the government is big on small business right now.As I said they will pay you a certain amount for the first year to help you survive. I thought about starting my own mobile dent repair service. You take a course, buy the tools and repair small dings and dents in cars (seen it on Dream Car Garage).Dealerships use these guys because its cheaper to call someone in to reair a small dent than to send it to their own body shop.Its an idea,and with U.I. helping out for the first year it might be something to look into. Plus there are government grants for certain small business. Look into it

That is a good point thanks! Only trouble is EI doesn't cover being fired. Well until I prove wronful dismissal anyway. I have never collected EI benefits and it's about time I get something back from it. If all goes well I am seriously going to look into there small buisness program. Again thanks!

The notice periods in the ESA are only a minimum standard and the Courts usually award more. Also, he probably owes you severence pay as well. Both of these catagories are contingent upon the number of years you've worked for this a-hole.

Wrongful Dismissal:

I don't think your conduct amounts to theft so there are no grounds for dismissal. For example, long term EE takes machine home to fix and brings it back when a-hole ER asks where it is. If he though it was theft - why didn't he fire you right then instead of waiting until later when you confronted him about his conduct of the matter.

Constructive Dismissal:

Occurs when they make it impossible for you to continue working there. In this case (1) accuses you of theft (2) went around asking where the thing was even though he knew the answer and now everyone there knows you got canned for theft.

Damages:

If you succeed on wrongful/diss - the notice period is usually extended until you get another job but you can't sit on your a$$ - you have to be looking.

There may be a monetary award to compensate you for the ERs conduct regarding the manner of dismissal ie your reputation vis. the allegations of theft.

The ER can also be required to provide you with a reference.

Problem:

Getting someone to sue him on a contingency fee basis so you don't have to pay unless you win.

Conclusion:

That's all I know about empoyment law and it may not be 100% accurate but it's not far off and some of it might be of help to you.

That will definaetly help right now. And he has only 7 days to pay me this termination wage. It's all up to him what I do know. He is the bearer of his own future. I have no idea what that has to do with this post but it does make it 3rd gen related. You have to remember no one really seen my car go other then that 1 time. I had a bad intake leak which was causing a bad backfire. And crap 16.1 isn't bad considering I spun the tires from 1st to 2nd and then completely let off the throttle to gain traction agian and then put it to the floor again. My set up should get me in the 13's once I've got all the bugs out. We see my friend...we'll see LOL! I can build and reprogram, and do a good amount of repairs on computers. I may go back to school like I said...just not sure for what. Have to see if I can get EI first. Got to like that eh?? have to wait! I hate waiting! LOL

Usually in these situations there is some sort of sideways motivation. In this case I think we could reasonably assume that your former friend's wife didn't like you and has been talking **** to her husband and his father for some time to convert them to her view of the world...

sounds like things are starting to clear up...but i wouldnt give him a letter that says you wont take legal action...that would put you in a corner. definetly make sure you get your termination pay and x-mas bonus before do anything. good luck fella

Yeah that is what I am doing. I willl give him a letter saying I will take no action against him...but that is it. I don't want to fight and go to court over this...to much stress. I just want to be in the clear of that place, and make sure me and my family are taking care of. Therefore I will do what ever I have to. After all it is not my problem legally it is his.

Just an additional note: Unless something has changed in the last 12 months- you CAN collect EI if you are fired- but not if you quit without a definitive reason- i.e. if you were sexually harassed you can quit.

When you are fired with cause- i.e. for criminal activity or being negligent in your duties to the point of jeopardizing peoples' safety- they don't have to give you notice or pay in lieu of notice- but I think EI still can be collected.

Either way- when you go to EI, subtly change the story to: "He gave me permission to take the washer home to repair and then accused me of stealing it" and delete this thread.
