Driveshaft damaged, too bad to use?

Car: 89 Firebird T/A
Engine: 305 TPI
Transmission: 700R4
Driveshaft damaged, too bad to use?

So I bought an aluminum driveshaft off ebay and when it came in, I inspected it and it has damage various minor damage but there are two more severe spots.. One looks like a cutting bit or a
grind stone hit it and another looks like it hit something while it was spinning so it's got a score mark. I've attached links to some pictures. They're pretty big so let me know if you need me to scale them down.

Is this damage enough to not use it? I figure if it's bad enough, I'll just ask for my money to be refunded and wash my hands of it. Otherwise, I'll ask the seller to give me some money in refund. Anyone have any thoughts?

the pics arent working....

but, especially with a aluminum shaft with any flaws at all, i would not even think of using it.

And second that response... No point in using it if its damaged (won't be better than what you have and you risk more problems)

any sort of notch or deformation will make a stress riser and when/if it fails will come from there. i'd get a new tube put on it, cost should be less than 100 dollars.
