why me?

i was driving to the d.m.v yesterday and as i was making a left on to the road some one decided to speed up and try to go in front of me (on the wrong side of the road) i hit my breaks and my nose scraped the side of his car and he riped off my right side of my nose. i was just about to bring the car in for paint 2..

and the best part of this whole thing is the stupid cops are saying it was my fault. i was already at the dubble yellow line and he crosed it and hit me......... do you think thats right? :

that sux. Is your insurance gonna go up? I scratched up some bitches bumper backing up and mine went up quite a bit. Sorry to hear about your misfortune.

If what you are saying is true, hire a lawer and contest it, check with the lawer but if you win I think her insurance will pay for both your car and the lawer. If you are turning left even on dashed yellow lines (aka passable) someone isn't allowed to pass you. Now some states if you turn left over the double yellow line and there isn't a break in the line for the road it is considered illegal and you can get a ticket. (Ive been told this is true in FL)

Ya I would fight it. If the person was on the wrong side of the road and clipped you its their fault. Of course unless you rear ended them. In RI and MA its automaticly the rear enders fault if something happens.

I think you have these three options, the last probably being your best bet.
1. Just pay for the damages to her car and yours and not let your insurance company know anything, so your rates go up.
2. Hire your own lawyer and try to fight it in court. Did the person who passed you lie to the police about what happend? Are there any witnesses?
3. Tell your insurance company what happend, they of course don't want to pay for the damages. They may very well provide you with a lawyer free of charge, then pay for the damages should you loose. The down side your rates will go up if you loose, possibly even if you win.

I know it sucks but chances are the best your going to get is a 50 50, half your fault, half hers. Because there are no witnesses. Someone hit me actually driving in the wrong lane, and I could prove it, there was snow on the roads and no tracks in the lane he should have been in. They still said it was half my fault.
Another time in my fathers truck some idiot made a right hand turn and just as my father got along side him he decided he didn't want to make the turn, cut back to the left making an illigle U turn, and running a stop sign he ran him off the road into some mailboxes, and they said it was my fathers fault.

there was a left turning lane, what i was in so it wasnt illegal what i did. i just went down to the police station and they said i need to wait till monday to get the full report. but i told them bout the accident and one of the cops were there and he said that it was the other guys fault, so im happy about that. now i hope i get enuff money out of this guy to fix my car.

my first crash over the summer with my 85 cutlass with a pontiac 400 in it, i got hit buy a guy makeing an illegal left and it was 100% his fault i ionly got $1,900 from him and $1,500 was for the damage to my shoulder. they better no jip me again

i kinda wanted to sell my car the paint isnt great but its got a l98 with tpi 700 r4 tranny 3:23 posi rear 1986 iroc its got 4th gen seats a system (not a great one but its ok) how much do u think i might be able to get 4 it?

damn did that cutlass get totalled? If your injuries costed 1500. thats not much left over for that old car... well let us know on monday officially who's at fault. Maybe youll get a generous check. Hell maybe you can get a brand new paint job for free???That wud be awesome!

I would check kelley blue book first. And then assess from there what its worth from there. If you get some money from them you could always keep it sell the car and buy something else.

I think that with an insurance company and anything involving injuries they try and screw you over even more than they do with the value of the vehicle. If you call them and make a huge deal you can probably get more out of them expecially if you go as far as getting a lawyer to call for you. A lawyer would probably be able to get you an out of court settlement for around the cost of the medical bills and the actual value of the vehicle.

I really hope they say its his fault and you get what your cars worth. How bad is it, if its just a bumper skin, the support, light bar, and a fender or two get a quote from a shop have the insurance pay it, then get the stuff yourself from a junkyard, put it on and save enough money doing work yourself to get the whole car painted. Then you come out of this with a free paintjob, not a bad deal.

Was it legal to pass on that side of the road when the accident happened? Were you going the speed limit or under or over? Did they pass you doing over the speed limit?

If you were going the speed limit when they tried to pass around you. It is their fault.

If it was legal to pass on the raod you were on, and you were going under the speed limit, they were passing you and not going over the speed lmit, and you speed up when they tried to pass. You are at fault.

So if you were going to speed limit or even over the limit, they shouldnt have tried to pass and are at fault.

In Indiana, not sure about other states, if you EVER hit someone in the rear its YOUR fault because you could have prevented it. It can go either way in court.

IF you were honestly speeding up while they were trying to pass, because you dont like being passed or something, it is your fault. Take responsability, i only say this because so many friend of mine are like this. Otherwise, its their fault and fight them to the grave!

He stated he was in a left turn lane. There will never be a passing lane where there is a left turn lane so no there wasn't a passing lane. He was making a left turn, so he was going under the speed limit.
Sounds like the guy was
A. Also making a left and just wanted to get around him
B. Was going straight and couldn't stop in time so he tried to pass, or just thought that he would be a dick and try to pass

Its the other guys fault 100% if what he says is true. It wasn't a legal pass which should free him from all liability and entitle him to sue for damages.

im still w3aiting for the police repor to get dun but they said its still not ready for me to call today at 2. iv been calling since 2 and its now 2:34 and no one is picking up the phone. great police right?

I don't understand, he was in the turning lane, then you merged infront of him, or was he comming from a differant street?

Sounds to me like he was in the left turn lane and the guy tried to pass him on the left in the lane of oncoming traffic, but I could be wrong.

They do that a lot around here. The best part is they give you the finger because you slowed them down (so you're the *******), forgetting the fact they're inviting a head-on.

Dude if this is the case, fight it. And I'd really start pushing the PC. Sounds like they haven't done anything and they're trying to cover it up. Or the other dude that was involved has connections in the PD, so its miraculously taking so long.

That's weird about the police report... in my 1st (and only so far!) accident, I got rear ended. I was able to pick up the report later that day (it was 2pm when I got hit in my 84 Z... on the way to get a paint estimate! I stopped for a school bus letting kids off... the girl in a Corsica didn't... that was the end of my Z )
