It's funny, no response, or link to this supposed copyright. As is I expected..

Guess this will sort itself out in court ( I doubt any proceedings will commence) or will just fizzle away.

What I find funny is Mr. Backus admits he didn't write the $58 ECU file... yet has a copyright for it..

The real question is : why would anyone actually want to use something as incomplete and inaccurate as the typical "ecu" file, for ANY serious tuning project.

If you simply must have an ecu file, we offer quite a few of these on our website for download, but be forwarned that we have not bothered to correct any of the mistakes that these files contain.
They are only included based on the fact they can offer a good starting point in the development of a PCM definition.

How I know Mr. Backus didn't write the ECU files is this.. "we have not bothered to correct any of the mistakes these files contain"

Had Mr. Backus wrote these files.. incorrect ECU's wouldn't be available.

What a waste of time...

i did a bit of reading this is his webhosting service for GMPCM> appearantly he hosts it from home or some other remote localtion. not for long man i sent a complaint of harrasment and your curent actions not withstadning i think youll find yourself without a host here very shortly. unless of course you own this hosting company. hmm again Mr backus come clean cuase the cleaners are comming.

oh also make sure to read part 12 of the agreemnet the aup agrrement that is. hmm i wonder if making flase or misleading statements about ownership of copyrights or claiming ownership of copyrighted material is also considered to not be in line with the AUP or spirit of the aup agreement.

What a tool. Good luck in court if it resorts to that. I'm actually amazed that this guy claims to finger print HIS work.

I'd really like to take a moment, and Thank Mr Backus.

And if I may, explain why.

When I was a youth we were taught, the priorities in life were ***, Country, Family, Self. It's a rather dated view, but I can understand so much better now what it looks like when someone gets that confused. While some folks promote the idea of trying to be educational and informative, you apprear to want to stifle that. And you've made perfectly clear what so much coincidence looks like. At least you admitted to coping the DIY-EFI .bin library, but everything else you seem to offer is just so coincidental, from the most popular of Masks, that have mostly public domained to including the WB patches that have been publiclly domained. Yes, I see alot of originality in what you offer.
I've always thought and treated EFI as just part of life. While educational, and for most of us a hobby, it also invites one to use logic, develope a sense of experimentation, and free thought. Being able to think in the abstract is in part, what I think seperates us from the creatures that roam in herds.
Since becoming ill, and especially since transplant, I've taken to try and be informative, and a good person. While at times, my shortness, not handing things to people on a tray, conversation, and spuring people to investigate things on their own have been mistaken by some as being mean spirited, well, it's just the opposite. When I was growing up, those are often the tactics that my teachers used, so I tend to use those same tactics. While they no doubt won't work for everyone, they seemed to have worked for me. I've actually tried to make the world a better place, just for the joy of doing it. Ask anyone that's actually meet me, and I'll assure you, there are few if any that have anything bad to say about me.

After reading your replies to other threads, and letters that have been included in this thread, all I can say, is I'll try even harder to be a better person. I really will.

While this may seem sarcastic, it's not meant to be. It's just that you've gone to such an extreme, to show others what a certain behaviour looks like, I thought it only proper to thank you, and be specific about the reasons, and how it seems our outlooks on life differ.

Again, Thank You...
Bruce

Hmm, for some reason http://gmpcm.home.comcast.net/main.htm
doesn't seem to be working. Oh darn Hope that keeps up
:hail:
BTW, does this moron have any idea how hard it is to win a copyright infringement suit if the person being sued fights it? Hell even if he could win, it's not like he makes REAL money off of this crap, he'd have to take you to small claims court.

Two things must happen:

1) Someone needs to contact Comcast. I'd be curious if Mechanic has a business account. Since I could not find any record of a business license, I'd imagine he doesn't. This would lead me to believe he is running a hobby. The problem with that, is the acceptance of cash funds. I'd like to know if these donations are being reported to state and federal IRS. Is he registered as a not-for profit organization?

2) Magnus needs to be convinced to release his (very nice!) TunerPRO software with source under the GNU license. I know there are a lot of good programmers who could make modifications to the effort.

Agian guys its good to finally see everybodyt working on something together for once. What would be really nice is if we all took some time to write to both the dnydns.org or whatever it is and to comcast as well. i thik with enough email they will come down on backus and force a shut up situation. either way if we dont speak up and we back down he wins. Im am dealing with my own hosting issues right now. I can assure you it will be dealt with no later then monday afternoon.

Rhuarc31,

http://www.gmpcm.com/main.htm

Seems to work fine. There was a time shortly after the holidays when I and at least one other were locked out of his site. He (they?) had just released their 8DPCM and I posted some errors with the data it displayed from my bins on their BB. It wasn't recieved very well and I was locked out. I could access the site from work but not from home. Tom Wong I believe was having some "issues" with Mr. Backus at the same time and was locked out as well. After about a month I was able to get back on the site from home. I still get wrong data from his 8DPCM so there is no point in using it for me.

Regards,
Gary Anderson

I can't get in it either. Looks like he was either shut down by his provider or he shut it down voluntarily.
What a ****-ant.

I'm sorry guys, it's been a while since my last visit, can anyone PM me and explain WTF happened? I've tried to search a bit and all I've read just confused me a bit as to what has apparently happened. I just don't understand Mr. Buttkiss' claim nor his standing?!?

One other thing I'd like to mention, I've seen this bantered about alot:

(sorry anesthes, I just happened on yours in this thread)

Copyright protection subsists from the time the work is created in fixed form (written, typed, drawn, etc.). The copyright in the work of authorship immediately becomes the property of the author who created the work. YOU DO NOT HAVE TO FILE SH*T. It may be in your best interest, but nothing needs to be filed in order for the owner of the work to own the copyright. It is automatic!

So anyone who may be at risk here <b>PLEASE</b> try and find something date stamped (ie a cd bkup burn, dated print out etc.). (This is why struggling authors and writers mail copies of their works to themselves, it's chaep and effective so long as you get the post mark over your package's seal.) Registering your copyright is an exceptional way to prove your claim, however, it is not a necesity!

That said, I think Mr. B has a very tough row to hoe and should he take any legal action will probably open up a can of worms he never thought of. My bet is his lawyers are being paid hourly and I don't know any lawyers who wouldn't mind a little defense work either.

CYA time for now eh?
