Whats wrong with this tranny and shop?

Ok so I had the local specialty parts shop install my new 350. I got the car back in a fair amount of time, paid in full. I drove it home and over the course of ahving it for 2 days I found that the tranny was flaring and making a scraping sound shifting from 2nd to 3rd. I brought the car back in and drove around with the mechanic. He heard the scraping noise and felt the flaring and said to leave the car with him. SO I left the car there and they said "Oh the tranny guy didn't know you have 3.73's or that you had a 350 going in instead of a 305, sorry" So after that they said ok we'll fix it.
This is a really really nice shop so the owner was rippin people right and left about making a mistake that big. SO 1 week later they say they need more parts yata yata there still working on it. Then I call this monday and they say "our tranny guy wasn't putting a good enough effort into what he was doing and it's not shifting perfectly so were gonna switch tranny guys, try back this friday" (Today) I get the car back late this afternoon. My parents pick it up while im working and drive it home. I get home 20 mins ago all excited.
I hop in the Z and proceed to drive it in a ****ing circle because IT WON'T SHIFT OUT OF FIRST GEAR. I killed the engine in my driveway, then turned it back on and manually shifted down into first (Its an A4) and when I go from park to 1st it almost stalls and all the lights start to die, it barely recovers so I try driving it and shifting but nothing happens reguardless of what gear im in. (ast,2,3,OD) its all the same. Just keeps revving and won't shift out of first.

Talked to my dad on how the hell he got it home on the freeway and he says it shifts after 6500rpms and after that it shifts really hard so I have no friggin clue how the guy at the shop could tell him "It drives perfectly, exactly the way it should"
Im no car expert but is it normal for an auto it ONLY shift once it hits 6500rpsm?

As for the tranny, sounds like the throttle valve cable isn't adjusted properly (may not even be hooked up). Hopefully, it's not too late because a mal-adjusted TV cable is quick death to a TH700 tranny.

As for the shop, sounds like they're over their head. An owner that rips his employees instead of helping them solve the problem isn't exactly what I'd call "nice".

Adjusted the TV cable and you were right. Works fine now. Reguardless I'm gonna call the shop on tues and ask them what they think just to find out if they have nay doubts on anything.

After finally getting the car back and adjusting the TV cable the GLORIOUS transmission has started to make the same grinding noise from 2nd-3rd.
Heres what im thinking of doing:
a)Buy a used th350 or any better tranny and have them rebuilt it. (Me pay for tranny but not for rebuild)
or
b)Bring it back and stop being nice.
or
What do you guys think would be a good thing to settle with instead of a or b? unless you agree with one of them.

You can be firm while still being civil.

Take it back and get it right. Sounds like they are taking responsibility for messing up the transmission in the first place even though they were only doing an engine install, but that doesn't mean they only need to try once.

Either have them try again to fix it or get them to agree to pay to have a shop that specializes in transmissions fix it. I wouldn't settle for living with the non-overdrive/non-lockup TH350 because somebody else goofed. Especially with 3.73 gears.
