It varies from state to state. The DOT laws state the that tail light has to be visible at a certain distance at a certain brightness. In California they are not legal. I have quite a few friends who are police officers and most would overlook that offense. Of coarse if your doing something stupid it is just an excuse to pull you over.
Odds are I would say that 98% or more would not just pull you over because you have tail light covers on. If you like them put them on and if you do get a ticket it will be a fit-it-ticket anyway. Then you can just pull them off and get it signed off.

import shops sell sprays that work just as well as covers. you can smoke, or black out your tailights with a stock look.

ya there illegal but i had them on my rs for about a year without being pulled over for it, till they got stolen

Interestingly, In Sonoma County (Santa Rosa, Petaluma, Sonoma ) the local police have a hard on for things like that. They are even **** retentive about the clear plexiglass covers over licence plates (I work for Juvenile Probation).
Yes, our cars look so damn good with the smoked covers; it's just a matter of deciding if it's worth being pulled over at an inconvienent time. I personally have an issue with authority and just hate being red lighted for trivial crap, so I keep my commuter cars very-very stock looking..

I've had the blackouts on my last Firebird, got lucky I guess and had no trouble.
For the most part, they don't pull you for that, but if they pull you for something else there's a good chance they'll tack that on if they know anything.
That being said, yes it is illegal.
And yes I will be putting them on front/back on my GTA eventually.
