News* Crate Warranty Void? Never!
I hear alot of people saying stuff like "I cant change the cam in my new crate engine or Ill void the warranty"
I was surfing the web for government stuff and found this:
Contrary to what you may have been told, heard or read, an aftermarket part will not void your vehicle/product warranty. The Magnuson-Moss Warranty Act passed in 1982 makes it illegal for a manufacturer to void a new vehicle warranty if the consumer uses a non-OEM product unless that manufacturer provides the product free of charge. If the manufacturer does not provide the product free of charge, they cannot void the vehicle's warranty simply because you have installed an aftermarket product.

Im not 100% Sure this means you can go out and change your camshaft in your new engine, but it seems to me thats what its talking about.

I think that is for a new car not a new motor
if you are buying a crate motor then I doubt it would be help up to the same restrictions

I'd also agree that this law does not pertain to a crate engine. You cannot be responsible for an engine that you make if someone else dissasembles it and replaces internal parts, period.

I don't think its as cut and dry as some think. A line has to drawn as to what can be changed and what cannot. If you change the air filter and the engine throws a rod, it is absurd to think that the filter had anything to do with the engine's demise. Same can be said for spark plugs, oil filters, mufflers etc. In the end it is up to lawyer and judges to interpret the applicable laws. It would be good advice to read over the crate engines warrantly with an eye of caution before making any internal modification to the engine. And then decide what you can and cannot replace.

On the FAQ section or some other part of this website forget exactly. It does say that the mod has to be proven to have caused the problem in order for the warranty not to cover. But I would rather not take the chance, I'm sure these companies can be tricky in getting out of that stuff.

It refers to new vehicles not replacement motors so you're on thin ice there. You'd have to see the entire Act and find out how it's been applied by the Courts. Does that Act even apply where you live.
Also, even if you are right you'd still have to litigate the matter if the company refused to pay out on the warranty. My guess is that, even if you wone in Court and got all your costs and so on, you'd still lose money on it one way or another.

I remember seeing a story a year or two ago involving AMGeneral and Porshe . Basically the courts said that an aftermarket part must be proven to be the cause of the part failure. That includes even a supercharger or turbo. I'm not sure if this would apply to crate engines or not.

That law was for a lot of things. One item I remember is so that electronics manufacture's couldn't void you warranty because you put energizer batteries in their product instead of duracell as outlined in the instruction manual - that Duracell provided financial incentives for.
One thing that's being overlooked here,is that the burden of proof is on the plaintiff,you being the plaintiff.If the dealer re fuses to give you a new engine , you have to prove your case.Could get exspenive!

an example of which is when you get your block back from the machine shop. if you don't take the time to clean things properly and assemble them to spec, ultimately you are responsible. even if you can prove negligence by the machinist (ie: didn't bore one cylinder out far enough, caused a piston skirt to crack), once and engine has been run, there are millions or other excuses that the machine shop can use to deny your claim. this is why the wise man said, "measure twice, cut once"
