court date tomorrow

any tips??

Charged with dangerous driving after doing a really fast lane change.I saw him behind me so I signalled the whole time..Guy in front of me cut me off so instead of braking hard I changed lane.Since I have to exit right off I went really fast 2 cars down and changed back to the same lane..Since it was a merging lane I was close to the guy in front of me..Any advise to make it fair for me?

Biker Cop advised me to go to court for this since the "the charge seems to harsh" for what I did..I figure since its kinda a cross between an improper lane change and a followin to close he picked the dangerous drivi ng charge..I think

I am already planning on getting there early and having a chat with the crown attorney

"Leaving yourself an out" and using it instead of just slamming on the brakes is taught in defensive driving.

This is why they teach you to always check your mirrors to be aware of all the cars around you and where you can escape to in an emergency, like when you're suddenly cutoff.

Explain to the judge that you were not trying to simply jockey up a few positions in traffic but had to manouver to avoid
and accident with the car ahead. Then had to get back in that lane because the other lane was a mergeing lane.
If you maintain that you were aware that there was space in the lane beside you and could make a quick lane change safely to avoid hitting the car ahead, then that is not dangerous driving.


If infact you cutoff a car while doing this, then..........
It's up to you to make a clean lane change.

But you will get to question what the cop saw etc. Where he saw it from etc. He may not even show up.

If the crown will not deal for a reduced charged, plead not guilty and fight it cause at least you have a chance.but if you plead guilty with explanation or guilty the judge can only reduce the fine.

At any rate stick to your guns and do not admit any wrong doing.

If you plead not guilty the judge can throw it out, find you guilty or not guilty, or find you guilty of a lesser charge.

If the cop doesn't show up to court, doesn't that mean the charges are automatically dropped?

The crown will probably try to deal with you before your trial starts so that once the judge is focusing on your case, you and the crown have already come to a agreement. Don't buckle to whatever the crown wants, even though you'll be a little intimidated.

Showing up early like you say will probably solve the problem, as long as the crown isn't looking to see your mexican/chinese/swedish *** in jail.

I'm a little fuzzy on Canadian proceedings, but are you sure this isn't just your hearing? i.e. trial to come later?

the first time I just submitted my plea..In the past,I usually dont even have to plea...They just give me a court date

Sounds like Careless Driving.
Dangerous Driving is a criminal matter like when you run somebody over.

Fight it the best you can. Cops got nothing better to do than hand out tickets...
