I called his # and it was disconnected. I just got an e-mail from paypal. They decided in my favor. However, they can't get my money back unless he happens to put money into his account. What a crock ! I'd have been better off to send a check or money order.

If he defrauded you through usps then it can be a federal crime
The only trouble with that is he never even used a post office. had he sent him a box of bricks with a tracking number then things would be different. I just hope he gets his money back.

If somebody ****s me over, I don't care how much it costs, I will find you and beat the living **** out of you. More people should have this policy. It would keep sellers more honest.

Why can't paypal do anything about it, doesn't paypal hold both your credit card information and his??? If I am right, they should be able to withdraw money from his credit card if you go through the correct steps. The only reason I thought people used paypal was for credit card transactions. I assumed they would be able to remove money from his credit card with the proper paperwork proof from a defrauded customer of theirs.. Someone let me know what I am missing?? As I assumed paypal only dealt with credit card transactions.

andone, you can use a bank acct too. Paypal withdrew the funds directly from my checking account, then transferred them to his paypal acct. From there he transfers it to his account. If there's no money in his paypal acct, they can't do anything. I'm calling my bank tomorrow to see what they can do since it's a federal credit union.

for paypal, if you buy and sell stuff through paypal you have to give a whole bunch of info including bank account numbers and what not...paypal should be able to just take the money right out the bank account of the other guy, they don't only deal with credit cards...because i know i'm a registered user of paypal for buying things, but i can't accept a payment until i sign up for all the bank account stuff....so if he is selling stuff, paypal should have a savings account number or something on file, and should be able to get your money back...and if they just beat around the bush, just get a mediator involved, they cost a little bit of money but its almost gaurentteed to get your money back....

Nope sad but true but its illegal for ANYONE even uncle sam to take money out of your account without permission unless its court ordered. sucks but thats how it is. Right now he has a option to send you the money but i doubt he clicked the resolve dispute icon that would authorize them to send you the money.

I just got off the phone w/ paypal. They are still trying to get the money back. He refused to respond to the dispute. They said that after 30 days they will send a collection agency after him. But he isn't able to use his paypal account until he refunds my money. She said it might help to file a police report in NY. I'll probably end up there next weekend.

i never send things through usps anymore. i sold somethings on ebay and the post office is really screwed up with things. i sold this carb to a guy in texas once and he said that he never received it. i told him that i sent it usps and to wait a couple of days. still nothing. luckly i kept my receipt and went to the post office and they said that the receipt that i have cant track the package. all it could tell me is that i sent a package out that weighted this amount and going to this location. i emailed the receipt to the guy in texas and he did the same thing at his post office. then they said that i need to fill out some kind of form with them to see if they received a package from here to texas. it was a big hassle. you have to pay extra money with them to get a tracking number other than that you cant track it. luckly my friend works as a mail carrier and he said that sometimes packages get misplaced, fall off trucks, get damaged and so on. i gave him a pic of it and sure enought it was sitting in the unclaim office. what he said happen was that it fell off the truck and sat in the rain and the package was damaged and you couldnt read the mailing address or the return address. luckly for the guy in texas but bad for me since i had to eat the shipping charges again....but it seems in your case that this guy is a straight out scammer. i tried everything for this guy to get his package and i hope that someone would do the same for me.....he sounds like an *** thought

To me, this guy sounds more lazzy than "Im a crook" Kinda one of those guys that will say "Im coming", or "i'll get around to it, calm down", but never do. Youre parts are probably still sitting half wrapped in a box in his garage and hes either to busy or lazy and is bs'ng you about getting them out. Oh yeah, and dont just rely on the main USPS "Hub" to give you any info. He probably used a mailing center. I got one next door, use it to ship things all the time, so try looking up all the mailing centers in his area and give them a call, and by the way, their all independent, so they can ****er things up occasionally. Just my two cents.

I wish I knew whether the parts are on his car right now. I'd go gank them in the middle of the night and leave him a note under the hood. I'd love to see his face when he sees it !

USPS sucks majorly. I bought a intake off a guy a few states away and it took over a month to get here. My dad ordered a CD from Kansas to Texas and it took a month and half. What a joke in few days fedex could ship across the world.

For the record.

I am the other victim along with DeHoyos.

For the record, I HAVE NOT RECEIVED SQAUT!

Now Rick claims that he has to sell his car before he can send me my money back!

He must have confused me with E-Loan.com

I need my money back!

Chris D., when will you be heading out that way? Send me a PM, don't make it public.

I would highly suggest all of you that got scammed by this dirt bag to all send him an email on the same exact day, that you all are calling the police dept in his town, county sheriff, State police dept and the FBI and each of you give what happened over to the authorities. I believe if I were a scammer I would **** myself. Let him know that each of you now know about each others fraud and each will prosecute him to the fullest extent of the law. Don't take any bull**** - just give him 5 days and tell him if you each have not received re-payment by (5 days from now, state the date though) said date ALL of you will contact the listed authorities. A local authority would have to investigate that many claims made in 1 day against 1 person. CONTACT all those agencies, hell call the District Attorney for his area, they can get involved as well. Put serious pressure on this dude - F Him, Damn Scammer. I have yet to be burned but this **** pisses me off that we have such worthless pieces o Chit Americans in this great country. Sorry, going on a tangent. Seriously, all those that have been burned by this dude make a conference call together and formulate a serious pressure cooking plan that could conceivalby put this guy in jail and he will crack and get you your monies back. Accept no mailed payment, Paypal plus the 3% charge, or wire transfer only! My 2 cents - get his ***!

update>>

Update on this theif!

From today's email:
since you caused me problems by ruining my paypal account and threatning me

with the police by the way i called the local police and they said theirs
nothing you can do its a civil matter so i will see you in court i was trying to

work this out but now you can take a hike good luck.

I have already contacted the local police and they are working an investigation with me. They will take a while they said but they will be paying him a visit.
He seems to think that money grows on trees. Well, I have a surprise for him --- it doesn't. I will be taking legal action against this person and doing everying possible to get him to give me my money back.

If someone worked out a similar situation with another scammer, please PM me to let me know fine details. The police are working the issue and I try to contact them every 3 days or so.
Thanks,

PL

BTW: Don't buy anything on the forum without pictures, phone numbers, and physical address. Tell possible sellers that you will contact them prior to sealing the deal. Use the internet, there is a ton of information you can gather on an address or phone number.

I have been buying on forums and EBAY for almost 6 years and this is the first person that does this to me!

As a quick tip for all; use paypal and pay with a credit card. I was boned on an ebay HSR and I called my credit card company (Bank One) and the charge was removed from my bill right away. Many companies garuntee internet purchases and will refund in case of fraud.

I used my Visa Check card and the bank said they can't do anything. Also, buying on ebay is different from just paying thru paypal even though ebay owns paypal. I've already called them too.

That is a fallacy. Sad but true. Maybe spend some time in your local law library and you may find out why.

As for the vigilante undercurrent permeating through this thread that advises personal harm rather than legitimate legal action... knock it off or take it to PM.

Firstly it doesn't help matters at all, and it certainly can provoke the person with whom you are 'negotiating'.

Secondly, and more importantly, if something should happen to that person and you guys have all these nice posted threats on the board, what site do you think will be coming down posthaste and likely would not be going back up. Who else do you think would be summoned to court, if not issued a criminal warrant against?

Thirdgen.org does not in any way or manner condone that sort of thing.

Have some respect for Dirk and Iroc (and this community) and knock this idiocy off on the public forum.
