what would you do?

ok I have had my car torn apart since last august a budy of mine was suppose to help me repaint it I was gonna help do the work stripping it and sanding it down but he was supposed to do any body work that needed done and then paint it was only supposed to take a mnth but some problems and snaggs came up but it still is just in primer with body work still needing done and he hasnt worked on it since about october. I didnt have to pay the guy to much because he just graduated from wiotecha and was working detailing cars at my work and doing a little bit of body work the kid does nice work when he wants to but he hasnt worked on the car for awhile and everytime I ask whats going on I get an excuse. Should I take the car back and take it as a loss and try to save and get someone else to do it, wait for him to finish the job or any opinions, keep in mind Im a college kid only working part time and dont have barley any money to spend, the guy was paid 90% upfront because he was doing me a favor so I gave him the money to fix up his car with some rimsa nd exhaust and what not, so what should I do

90% upfront eh? Bad move. If anything, you should of given him 30-40% and have a date of completion from him. Im not one for violence, but if i'd thrown my hard earned money on someone so he could finish his project and not mine, there would be hell to pay. Word of advice, dont complain, dont ask, Demand that the job gets done as promised.

If that is the line of bs he is giving you then it is time to get serious! You paid him upfront for a service, which you should never do again (consider it a lesson learned), and now it is time for him to hold up his end of the deal. Get firm with him, tell him you will take it up with the police or a lawyer. Make him understand that you dont want to get jerked around here, which is what he is doing. Afterall, he is enjoying his ride with it's new exhaust and rims!

Both of which can be easily removed and returned upon services rendered.

yeah, I'd give him a date by which you expect significant progress to be made (define exactly what you expect done) or you plan to contact the police. Let him know that you are serious and that if he doesn't hold up his end of the deal then he has in effect stolen your money. How much did you pay him and how much work was he supposed to do on the car?

I can't believe all that was only 3 sentences!!!

Anyway, don't bother calling the cops - its not a criminal act. It IS a breach of a verbal contract IF a specific date was set up during negotiation.

If it WASNT (and I'm betting it wasn't)...then he hasn't broken any agreement - so you have little ground to stand on. Sorry. If this is the case, I'd just keep badgering him until he finishes it.
