Yeah, REALLY difficult. Not to mention this lady has done this before and knows how to work the system. I understand why people take cash instead of getting police/insurance involved but it just hurts other people in the future. Bad drivers need a record to help protect others.

One should ALWAYS file a police report. Without a police report its very difficult to go after the at-fault person for damages. Especially if both parties have the same insurance. Insurance companies are notorious for doing a 50/50 fault when both parties carry the same company.
I was in an accident in a school parking lot back in high school. A mother was dropping her kid off and driving the wrong way when she turned a corner and directly into my stopped car. She didn't account for the icy ground. When the police officer filed the report she was the at-fault party. But it turned out we both had State Farm insurance so statefarm called it 50/50 and tried to raise my rates.
Thankfully my mother called our agent and blew up the agents ear drums. If I hadn't filed a police report it would have been very difficult to have the 50/50 ruling of the insurance over-ruled and I'd have ended up with increased rates.
Which at the time I didn't need as a 17yr old male, I had already been paying 2k/yr for liability only on a 93' escort hatch with a perfect record. But the "men are higher risk" argument is another one and I don't feel like getting into that.

Alright everyone, so here's another update. Took the car this morning to the claim place and got the car assessed, needs a new bumper and fender. Turns out that she's also admitted 100% fault (thank god) because it's basically impossible to prove that I was speeding. Now he's the possibly bad news, the adjuster said that the damage on my car might cost more to repair than the value of my car so they might write it off and give me money for it. But that's just a maybe/possibility. If they do decide to write it off do you think I should take the money and save up for a Trans am?

I have a 86 TA,my insurance will only cover it for a total loose of $6,500,(I could have it appraised and they would insure it for the appraised quote).My point is how much would your car appraise for and you could decide if it is enough to do what you want.

When I bought my Son his first car Honda CRV, the first week he drove it to school he was pulling out of the parking spot and a kid hit him and the kid said my Son hit him. So my Son called me and the Kid called his mother. I knew that if my Son was to blame the insurance would go up sky high. So I asked the Mother of the kid if we took the blame if she would mind if I said i was driving. She said that would be fine. so I took the bullet. My insuance fixed his new lexus. My Sons car had no damage. That was seven years ago, and he never has been in another accident. I sure hope things work out for you. Oh and I know it does'nt sound right that I took the blame, but I didn't want my Son to get a bad start. The only ticket he has ever gotten was for click it or ticket week! I was glad! Now he always buckles up

That is so unfair. Rich kid dents his Lexus and doesn't want to admit to doing it. You did the mature and right thing by taking the blame so you don't have to deal with them. I also think it was great what you did for your son. Not many parents can say they did something so noble for their child. 


Okay so I got ahold of the claims office and got the news. It's both good and bad. The bad is, unfortunately they can't save the car and has to be scrapped. The good news is, I bought the car for $1100 and they offered to write me a check for $2348 so I would be making a profit and which is a lot more than I could sell it for (know from experience). With that money I could save up for a Trans am which I've always wanted. But it's really upsetting to think that she's going to be used for scrap.

I totally agree, it has a nice sound system in there with a kicker sub and alpine dash and rear speakers that I'm taking out to use for my next car. I'll take out the new console faceplate that I got and put back in the old one with cigarette burns and stuff.

I feel your pain, I was admiring my last Ducati out the window of my office one day and a super senior ranking military officer (the dude killed people with a MRE spoon in Afghanistan...scarey guy...and way out ranks me) drove into a parking spot and kissed my bike with his frign Volvo bumber in the parking spot next to it...of course it wobbled and fell over. He walked out to it, picked it up, brushed it off and went into his office. My office had mirrored glass on the outside so he didn't see my jaw on the ground starring at him. People who don't know motorcycles or, like your teacher in the mini-van, its not really a big deal. So what if one of her 3 kids runs his Razer scooter down the side of her Caravan. Or starts beating it with a whiffle ball bat! Ya know. In his defense he just thought, like a bicycle, you knock it over you pick it up. I had to go to his office and be like..."Uh...Sir....Umm" It wasn't a real big deal because he's a solid guy and wanted to pay cash but just by calling the insurence company to ask what to do IF he wanted to file a claim, it gets recorded as a claim so he went that way. The Duc slowily fell over...$3500 in damage!

Sad to see the poor thing go. Nothing wrong with it except a dented fender and front bumper. Did it bend the frame? Ins. Co.'s don't usually consider a car totaled unless it has had the frame bent.

Like I mentioned before, the salvage price on my 91 Firebird was $477.00 so I got back the car and $2003.00. Bought a bumper cover, headlight assembly from Pick-N-Pull for under $200.00 and bought Bzavala's 88 Firebird for $850. Fixing them both up. You should be able to buy it back for under $400.00. Parts alone are probably worth that!

I don't think it did bend the frame and I definitely wouldn't consider the car totaled either, but it is what it is I suppose. I think this is a sign though, because in the back of my mind I've always wanted to get a trans am with t-tops so I think this is the best opportunity to go for it

That's definitely a tough decision. It's great that you'll be getting more than what you paid but it is sad to see a perfectly decent third gen go to scrap over a fender.
But like you said, now you'll be able to afford an ever better T/A which is awesome.
I keep a close eye on the local craigslist and Kijiji listings, here's a car that has been listed for a while and was previously $5,500. I wonder if you could get this guy to come down on his price a little more...

I saw that and I was the one talked the price down
he originally went down to $4200 and I kept saying 3grand so he decided to lower it to 3500. I'll try and talk him down a bit more and see where I can go from there

than how about you just buy it back for less than $400 and sell it as a parts car for $500. you could just sell it as a fixer but with the salvaged title might be hard. there is no reason this car has to go to the crusher for less than $400 bucks. ask them how much it would be to buy it back,when i got hail damage on a jeep it was totaled bought it back for 150 bucks and had a check for 2500. plus i had the car to drive around.

How much is your car worth? Mine got hit in the side a few months back (nothing too bad, just a door skin and some side moulding) and the guy's insurance wanted to total it! And my car is f r e s h.

to an insurance company its easier to just total it out, in the dealings ive had with them they can make they money back just from selling the totaled out vehicle for parts

I'm fine with them having it just as long as it's used as parts to help other firebirds get back into shape and not going straight to the crusher.
