New ones aren't in production anymore, so you're looking at rebuilt unless you get lucky enough to find a N.O.S. unit sitting on a shelf somewhere.
It would be cheapest (and not terribly difficult) to rebuild it yourself. If you're not comfortable doing it yourself, you can have a carburetor shop rebuild it for you, which for quality work might not be so cheap. Parts-store rebuilt units are a bit of a crap shoot in terms of quality.

what if i get a eldelbrock q jet carb ? is it the same as the stock? and will i pass emissions? and do i need to use a different intake manifold?

You don't seem to be getting it. Your only carb choice is a stock type computer controlled quadrajet, which are not available new and the aftermarket doesn't make anything like it.

because I want to get a new carburetor and do not want to rebuilt the stock carburetor and what if i get a carburetor that is not q-jet?

You're not listening very well. You don't have a choice in the matter. There is no other carb for you. Period.
You need to fix your existing carb, whether you "want to" or not. If you want to be allowed to drive your car, that is.
The only other options you have, are to go to the junkyard and get another one like it, and fix that one up, if yours is all hacked to bits or completely worn out or whatever; or to go to the parts store and pay giga$$$$$ and take your chances.

move to a better state. My car is an 86 firebird with a motor, ignition, and carb out of a 79 van. I don't even have cats on it. I can run any carb I want, My egr is non functional, and my gas fumes vent somewhere other than a charcoal canister. All in all if I drove it to california I'd be banned for life, but alas here in ohio I'm good to go

in california you can't modify your fuel delivery system unless you can get a piece that is a oe replacement
you carb is computer controlled
putting a carb on there that is not computer controlled is not a oe replacement
it will never pass smog because of that
you don't pass smog you can't get your car registered
you can't get your car registered you can only drive in to the track or to off road places but you CAN NOT DRIVE IT ON THE STREET
now if you found a computer controlled carb you might be able to drive it
problem is nobody makes a computer controlled carb other then quadrajet
so your stuck with getting a rebuilt carb from a parts dealer
as was said it's a crap shot at best
you can rebuild your own.
or take yours to a shop to have rebuilt

why do you want a non quad anyway?
with your car the stock computer controlled carb is going to give you the best results prolly
first you only a 305
you don't need much for carb there as is
the spread bore (big secondary small primary) is prolly going to give you the best gas mileage out of the bunch also as well as drivability
you want to put a non computer controlled carb on there you have two options
first one move out of the state
second one buy another car that predates computer controlled carb stuff that way you should be able to swap another carb on there
but why not just get the stock rebuilt?

you do have one other choice. Impco makes a propane carburetor with a quadrajet base that has been issued a C.A.R.B number.
When you get your stock carb rebuilt be sure to have them check the throttle shaft bore for excessive wear. if you plan to keep the car for awhile you should have bronze bushings installed
