Weird ALDL behavor

Weird ALDL behavor
Well, after 2 years of service, my ALDL cable, gave up the good fight. so i build a new one. now, i have been doing this long enough to know how these things are built, it isn't a sodering, schematics botch.
here is what is happening.
Car in On Position, i get data
Car running, i get no data
This is on a 8746 ECU, i am using the 2 10k and a MPS2N2222A Transistor (only one i could find at the shack, the last one had a good ol' 2N2222). Is it possible the packaging was mislabled and the emmitor/collector are labled wrong? I am not anysort of electrical genius, so i don't know exactly how it would behave if those were messed up. It is just strange that i am getting data in the on position with the car off, but data when the car is running.
