Its never legal to run open headers on a street car. 99% of all cities in the United States, if not 100%, have laws about maximum decibel limits allowed from motor vehicles. You will not be under the decibel limit with open headers.
At the race track, you can run open headers, unless the race track itself has a rule against it.
