Legislation to Repeal Old Car Emissions Exemption Reintroduced
in California State Assembly
Here we go again! As predicted, legislation has been reintroduced in the California Assembly to repeal the state's current rolling emissions test exemption for vehicles 30 years old and older. A.B. 2683 repeals the current pro-hobbyist exemption and replaces it with a provision requiring the permanent testing of all pre-1976 vehicles. This year, the bill was introduced by California State Assemblywoman Sally Lieber (D-District 22).
We Urge You to Contact Assemblywoman Lieber and Your Own State Assembly Member Immediately to Oppose A.B. 2683 Existing law in California exempts all vehicles 30-years old and older from emissions testing.
California's current emissions testing exemption recognizes the minimal impact of vehicles 30 years old and older on vehicle emissions and air quality.
Vehicles 30-years old and older constitute a small portion of the overall vehicle population and are a poor source from which to look for emissions reduction.
Antique and classic vehicles are overwhelmingly well-maintained and infrequently driven (about one-third the miles each year as a new vehicle).
Legislators and regulators are feeling the heat from a failed effort to meet air quality goals and are looking for a convenient scapegoat. The old car hobby should not carry the burden of their mistakes!

Dude that sucks...I think in ohio it is 20years...I have an 1984 Trans am. I was thinking about getting the historical plates etc. But I decided not to. I don't want anyone to tell me how many miles I can put on my car every year.

Well, I got a response from one of the California senators I emailed:

Dear Mr. Hanson:
In August, you wrote to oppose AB 2683 and the effort to impose smog
controls on older vehicles. The author substantially amended her bills and
thereby granted an exemption to all vehicles with model year of 1975 or
earlier. A copy of the bill analysis is enclosed.
I supported this bill when it came before me in its amended version. Failing
to amend our current law has profound impacts upon air quality and our
economy. One example illustrates this point. In the 1970's, Lockheed
Martin and McDonnell Douglas manufactured passenger jet aircraft. McDonnell
Douglas painted its planes in Long Beach. When new air quality standards
came into effect, these California jobs disappeared because the planes had
to be painted out of state. I am highly confident that furniture and paint
manufacturers in Southern California face a similar choice, today---
shutting down or moving out of state. Both industries are prone to
emissions of volatile organic compounds and other controlled gases that, in
the aggregate, are tightly controlled in part to offset the impact of older,
less clean, motor vehicles that remain on the roads.
AB 2683 would repeal the 30-year rolling exemption and instead apply the
smog check exemption strictly to vehicles manufactured prior to the 1976
model year. 1976 model-year cars, on average, emit 155 times more
hydrocarbons per mile than new vehicles and, despite their very much smaller
share of the vehicle population, these vehicles continue to emit two to
three times the volume of pollutants in aggregate. By 2010, pre-1982 cars
(those that would be exempt from smog check at that time under current law)
are expected to account for 22% of the hydrocarbons and 11% of the NOx
emissions despite representing only 2.6% of the vehicle population and 1.3%
of the vehicle miles traveled. I would also note that you, as a collector,
are very different from many vehicle owners. You maintain your car. Once a
vehicle is exempt from the smog check, there is little incentive for a
non-collector to continue to maintain its emission control equipment nor is
there any mechanism to assure that such equipment has not been modified or
removed.
I have previously supported the continued exemption of older cars from the
smog check laws. However, we have to draw a line, starting with 1976
vehicles. We've fought hard to get California's economy back on track. The
recession has devastated the family finances of hundreds of millions of
Californians. If removing a few cars from the roads can produce such
profound outcomes as indicated above, and leave room in the air quality
basin for existing businesses, then I will continue to support this bill.

These are the same state officials who willingly turn a blind eye to thier spouses driving around that decades old diesel Mercedes which spew smoke so thick and rank it makes me gag.
Where are the emission inspections for these cars ? or for any diesel powered automobile ? I'd be willing to bet that cream '84 turbo diesel i was behind this morning accounts for 155 times more hydrocarbons per mile than new vehicles.

Not sure what McDonnell Douglass has to do with vehicle emissions, but I'm pretty sure there's a money connection somewhere... like money in his back pocket from someone getting an emissions credit (***cough*** furniture and paint manufacturers ***cough***) for voting for this steaming pile of dog doo. Same thing as the other emissions credits floating around, ignore the real problems and solutions, and go after the little guy with no clout and no voice, because you can.

We need to enlighten this guy.
1. Paint fumes and vehicle emissions are two different things.
2. Painting one airliner can emit a lot more pollutunts than a old car.
3. Why can industry get pollution credits and I can't. I should be able to own a 2nd gen and a new small car and get credits from the new car to balance the pollution from my 2nd gen.
4. If what he says is true why are business leaving California almost daily. Tonights LA's NBC news says 3 large business's have left Calif for TJ this year leaving over 800 unemployed. One is a wheel mfgr and another is Precison Metals. The reason they are going to Mexico is; no pollution laws, lower wages, no workmans comp, etc. Horray for NAFTA.
The pollution from TJ comes back to Calif and ends up in the Salton Sea, proven fact. Raising the mininum wage won't keep business here. Requiring all employers to provide health ins won't keep them here. But smog checking 30+ year old cars will, LMAO.
5. This is typical political BS. Keep the campaign donating business' happy by screwing the individual citizens.

No emmissions stuff in your province??? Ontario has emmissions testing... not strict like California tho... but its still a pain. If they wanna limit exhaust gases, why is it they don't do more about diesels cars or transport trucks... guarantee they spew out more than any other cars on the road. These stupid laws have nothing to do with caring about the environment... its all just money... I heard of a guy who had a high performance car, but had no emissions equipment on it. The car tested close to zero emissions, but they wouldn't pass him cause he didn't have any emissions equipment on the car... stupid...

You got it right friend, It's all about the money! Everything these days is about the money. It makes me sick everytime I look at a piece of US currency where it reads "In *** We Trust" That is such bullSh_ t! What it should read is "In this we trust" *** is just the escape goat.

Do you think that if enough of us pooled together and went up to Sacramento the day before they vote on the bill and protest, we could make an impact?
I know it'll probably be useless, but still, the legislature generally shows some interest when pissed-off taxpayers show up on their doorstep.

We are fighting big money.
The AQMD did a study and on it's own web site states that 70% of the cancer causing pollution is diesel and 90% of that is mobile; cars, trucks, boats, trains, planes.
But it is easier to pick on the individual citizens.
For those who haven't expereienced it yet, the worst is "take your vehicle to a test only station". These guys want you to fail to justify their existance, each test unit pumps out 3 to 4 cars per hour at $50 each. The dumb part is;if you fail at a test only you then get your car fixed elsewhere and then ANY smog station can retest your car.
And the trucking industry will fight any attempts to make them comply. And these big trucking firms dump their waste oil into the fuel tanks of the trucks to avoid the used oil recycle fees.
I really hate politicions that ignore their own agencies findings to placate their campaign donors. I sent all these Senators and Assemblypersons the link to the AQMD report.

Just received my SEMA report
AB2583 was passed by one vote by the Senate Committee.
All that is left is passage by the full Senate and Arnold's signature.
Arnold is Ok with the bill if they add a collector car exemption - which would probably exempt Ferraries, Bentlys, etc, but not a TTA or 3rd gen conv. etc.
No date when it comes to Senate vote.

I guess what really upsets me most about your reply is your total disregard of your own agencies findings, specifically the AQMD. If you access their web site at http://www.aqmd.gov/news1/2004/matesIIIpr.html you will see that 70% of the pollution is diesel and 90% from mobile sources, cars, trucks, planes, boats, trains. At this time ALL diesel vehicles are exempt from smog testing. I don't see anything about diesel vehicles in AB2683.
Also, pollutants from paint products is totally different than internal combustion engine pollutants. They are not the same and reducing one has no effect on the other. Lets be intelligent here and not try and mis apples and oranges to create a clear vodka martini. (Ted Kennedy proposes a toast).
Business' are leaving Calif for TiaJuana, Mexico due to EXISTING pollution constraints on them, are you planning to reduce the pollution constrants on business to keep them here. Won't work.
Thanks to NAFTA it is extememly profitable for business to move to Mexico; no mininum wage, no Workmans Comp, no pollution cops, lower or no taxes, etc. And the pollution they create down there comes back to us and settles in the Salton Sea (proven fact).
Los Angeles NBC news on Aug 16 named 5 big companies that moved to TJ this year, the latest being Precision Metals, these companies have left 0ver 800 unemployed.
If you want to keep business' in Calif requiring cars over 30 years old to be smog checked every two years will not help at all.
To top it off Powdercoating companies, which DO NOT pollute, are required to submit seperate reports each month to both Calif and the Feds. It's bad enough to run a non-polluting business but to have to submit TWO reports thats why business' are leaving.
My vehicles meet currant smog standards, but every time I get them smogged the pass/fail bar has been lowered to try and fail my cars and having to go to "test only" stations only increases my frustration with the currant system so I guess since I already have a 1973 vehicle I will sell my 86 and 97 and get two pre 76 vehicles. I always wanted a 67 Grand Prix Conv and a early TransAm big block.

Wait do on my 68 Firebird they are going to make me have to smog it??? HOW IN THE HELL CAN A NON EMISSIONS EQUIPED CAR PASS SMOG? Also dont they have to sell parts that were origonaly put on the car for it to pss smog? The only good thing i have going is the ****'s wont know its a 455 since all pontiacs blocks are the same and i dought they know the head codes. I allready wrote one nastletter before i take it they didnt listen to me. Classics are few and far between i maybe see 1 classic car a day on the road compared to the 100000's of new cars.

Here's the deal: if you dont like smog, move out of the valley!
Proven geological fact #1:
All airborn pollutants will settle in the lowest point avialable. Therefore, in a city like LA, which is surrounded by area higher than itself constituting the lowest available point, will literally collect all the smog for miles in every direction. Some of that smog doesnt even come from the city! It comes from the surrounding environment.
If you dont want to get schitte on, get out of the toilet. Move to Florida. A nice strong breeze all year keeps us clean. And there is no emissions testing. For any vehicle, brand new off the show room floor or 60 year old hot rod.

...and sometimes the breezes in FL reach 100mph. Like this being the 4th major breeze in 6 weeks to affect central FL. I guess that'll clear the air a little. Yard cleanup will be necessary and in some cases a new roof or windows, but I can keep my car!!
