Reckless Driving.

I live in Wisconsin and on Friday, when i was leaving school, i hit a patch of gravel while turning and it kicked the back end around. When i corrected i over corrected and was faced with hitting a car or a pole. I chose the pole. Since i was in the area of my school, the cops gave me a reckless driving ticket..

Is there anyway i can fight back with Inability to Maintain the Vehicle?

Or should i just butch up and take my punishment, even though i wasn't driving recklessly i got a stroke of bad luck.

Educate yourself. Did the cop see you hit the pole, how close is near a school. Find out what reckless driving is in Wisconsin. If your going to fight it you better have some facts.

Thanks for the feedback. I've been doing research since i got home today and i could win and lose it on two facts i found. No, the cop did not see me do it, and my passenger told me he felt i was doing what i could to keep him safe due to the circumstance.

The law says that reckless driving it primarily due to speeding, but may be made an acception due to one who DRIVES without reguard to the safety of those around him.. But! I wasn't driving that way, the only reason i was put into that situation was because the car slid on the gravel.

Also, it was on the road infront of the school.. ><

Fight It, Based on the facts that the state needs to prove their case, you are not guilty of either.
You have a witness to help you with your case, (your passenger)
The state has no witnesses, and that alone could sink their case.
It was an accident, plain and simple, it was not caused by anything that would be considered wreckless driving, at the worst you might tell the judge that you are still a bit inexperienced, due to age and the type of vehicle you are driving (hey, I know it might be tough to admit, but the judge might be more understanding if you at least sound honest) But don't bring that up unless the situation calls for it.
Either way, you should win it. You realy DON'T want a charge like that on your driving record! Guilty = Instant high risk category $$

u were obviously driven recklessly since you hit somthing... common man its gravel not ice, you really gotta be fukin around to through your car off that hard

yeah it's always worth trying to fight. when i got my wreckless driving(also in wisconsin) i tried half heartedly. i was 17 w/ a camaro and i knew i was being stupid. but now i wish i tried harder. insurance is sky high. try fighting it anyway. given the circumstances, you have a better chance than i did.

when i get in **** wit the law i usually getta bars lawer usually run me about 100-150 but it beats having **** on my record. u might just want to call a few free lawers and offer them how ever little you want to pay.

It was on a single lane road with cars parked on the one side in a distance of not even 30 feet. I would have been able to regain control, if not for the cars along the road.

One option you might be able to use is that you shifted into 2nd while turning causing the tires to break loose because of the gravel. As an inexperienced driver, you overcorrected and chose to not hit a car. Explain to the court that you will be willing to take advanced driving classes thru the professional drivers/racing schools to learn how to better control this type of car.

Was the gravel light or heavy? Do you have posi? These all will help with the situation. Also explain that the car is a V6 and there really is no showing off needed with the car. If the car is not posi, then your screwed. A one wheel wonder should not lose control going around a corner under light acceleration.

The point the police will make is right in your statement that the car is a v-6 and he had to be showing excessive driving behavior in order to do what he did in other words this ticket will most likely stick like glue....sorry to hear

but next time you will look at the elements of the area around you and decide how you should take off

Your lucky you were able to hit a pole instead of someone elses car or even worse some one else.....next time be carefull ...

I gotta say, you musta had a little momentum going to slide on a turn.

I'd fight it simply for the fact the cop didn't see you. There's no way for him to correctly evaluate the conditions if he wasn't there. Plus you had a witness! I had a similar situation happen to me about 4 years back. Except it was a dusting of snow and a pot hole, slid right into a front yard of a house. And I was only going 5 over...

Get a lawyer. I tried to fight an illegal speed contest in a school zone. I was not drag racing. The cop said I was but I had witnesses that testified for me and the judge says GUILTY!!! I should have got a lawyer.

my brothers camaro isnt a posi and when we were comin home one time and gettin on the highway, he got on it a tad and it swung out on him a little bit farther than normal and we were facin the ditch in the median and he corrected and got on the brakes and we still ended up sideways in the middle of the highway, luckily no cars were comin

yes, get a lawyer. it will cost you now but, trust me it is worth keeping this off your record.


I had a case in a old 6000 that was very tired and worn out. well long story short a cop heard tires squeeling (this is right off of a main road in town and noon during the week) saw me driving and figured hey it's a kid must be him. gave me a ticket so I went to court and I had took pictures of the intersection and where the cop was ..... nope guilty! I even pointed out how tired the car was and how I would have to be on ice to even turn the tires over they don't care if it is a kid disputing it you are just a kid

Thanks guys. Depending on how much the ticket is when i get it and what the court says will make my decision.
