quick question about the law
Hi everybody, someone told me cops can't hide and clock your speed, is this true?

Don't know about CA but in PA every year the state cops dress up in Camo and with a portable rader gun hide in the bushes to get speeders.

its a fine line here in CA
they hide so that at a distance, but within radar range, you cant see them but they can see you. When you get within about 150-200 feet away they are mostly visable but thats too late.
So in answer to your question, they cant like in Ohio park a truck with a colored plexiglass back door to radar you, but they can partially hide.
Its also against the law to warn oncoming drivers of a radar trap.

Check the CA Vehicle code, I'm sure there's something about speed traps.

I always see cops in Ontario gunning people in pure sight.... I think it has to be illegal to hide out... I have never ever ever seen a cop gun somebody in the bushes or out of plain sight... and I have been gunned almost 20 times in my driving "career".
So there has to be some sort of law.

During the day it's usually motorcycle officers that will park along a street or at the corner of a side street. They are harder to spot in the daytime, but they are not invisible.

here in Tustin they have certain driveways the motorcycle radar cops park in.
The ones they use partially obscure them from oncoming traffic and their favorite has a tree that puts them in a shadow, very hard to see from a distance.

I got pulled over recently for speeding. I was clocked by motorcycle officer who was hiding behind bushes in a church parking lot. I did not realize he was there till I passed him, and it was to late to slow down. My speed was 59 in 45.
I am going to fight for two reasons:
1. cop was hiding (still looking for VC)
2. using church property which is a place for praying not for clocking speeders.
Do you guys think that I have strong case?

If you're guilty, why fight it? Be a man, admit your mistake, and have more control over your right foot in the future. Its not the cop's fault you were speeding, its your fault.

believe it or not, ive gotten a ticket and had to do traffic scholl before. One thing i learned in there was that all posted speed limits are recommended safe speeds according to the prima facia safe speed law. This means that though 45 is posted recommended safe speed, any speed up to 65 can be considered safe. You willl have to prove that the speed you were going was a safe speed depending on road conditions, traffic, pedestrians, and street size. So... if the road was empty, had three lanes, there were no pedestrians, and it was sunny, you could get away with it. I would say take flattering pictures of the street around the same time you got the ticket, say you were being safe, and try and fight it. Then again, my teacher smelled like alcohol so he may have been full of s***. I would check on it though.

Ivan trust me you don't want to try this in Court.. The judge and cop are going to get you good.. Remember where this Worlds brain is at right now.. It's all about the money.. Don't waste your time losing work or school or thought or interest to learn something new for that day.. It's way more worth it.. Playing Chess is no game.. Esp.. When they move all the pieces.. Check out those laws and go from there like they mentioned..
And Hey.. Put that Dam Y pipe on before you get in trouble this weekend.. or was that a Joke, haha.. And hey Don't Speed..

you dont have to try it in court, you can actually contest by mail. If the issuing officer does not return his written declaration the fine is dismissed. LOOK AT ticketassassin.com. Dammit i work for a legal service!!

You admitted you're guilty, but hey, we all f' up and have our moments. If you've got a real itch to win, hire a good traffic attorney. Simple as that. They work magic...I've seen guys get out of crazy speeds, just using loopholes in the law like "the cops radar was not calibrated properly," etc. They know it all. But for something simple as speeding, especially if not driving wrecklessly or speed contest, it's just not worth the trouble. Pay the fines, go to traffic school, or take the 1 point.

my thought of the law is if they are not in clear sight when you get radared then that is entrapment.its a pretty fine line of whats legal and whats not.

Off the subject a little, but Mythbusters did a "hide/confuse the radar gun" test.
Final reaults as expressed by one of the ladies on the show. "the best way to get out of a ticket is to cry and wear a short skirt.".
