How can I get them on my side????

Well, I was driving down the aisle of a mall parking lot in my Camaro. And some guy driving his girlfriend's Grand Am was cutting across the lot and pulled right out into my aisle and our corners hit. Well, we exchanged insurance information, and stupid me decided to wait to get a police report. I soon found out why the guy was reluctant to. I went to the police station after work that night. I told the officer exactly what happened, and he called the other guy. Well it turns out that this guy had a suspended license, which the cop couldn't do anything about because it was on private property. The guy also lied to the cop and told him that he was in park and I hit him. The cop new he was lying because he looked at my car and there's no way that could've happened. So the cop is on my side. Both of us have State Farm insurance if that makes a difference. What I'm asking is how can I get the insurance company to believe me so that I don't have to pay my deductible? ANY help would be greatly appreciated. I really can't afford that right now. Thanks in advance.

Tell your insurance your side of the story, and show them the damage. What else can you do but tell the truth?

Do I understand it right that you DIDN'T wait for the police to arrive and THEN you went to the police station to file a report? If so, you did the absolute right thing in lieu of waiting for the cops. Because you filled out the report AND the other driver has a suspended license in the eyes of the insurance company the other driver is 100% guilty! HOWEVER, you must notify your insurance company and have them file a claim against his girlfriend's insurance company (she owns the car). The other insurance company should send an appraiser to see the damgage and then cut you a check. You SHOULD not have any out of pocket expenses, but the claim HAS to filled against the other insurance company.

Oh I see you have the same insurance company so just tell the truth and make sure you fill out a civilian accident report (as opposed to a PAR - Police Accident Report)

If both of you have the same insurance company, then you might have a better chance...especially if you have a police report after the fact.

This is assuming the car is insured properly by its rightful owner in the first place (just showing an insurance sticker doesn't mean ****).

Depending on the types of coverage you both have, and whether or not you live in a state with no-fault insurance laws you may or may not have to pay a deductible.

For what it's worth, unless you are absolutely sure you can live accident damage without regret, ALWAYS get a police officer to document a traffic accident. In this case, the officer would have determined fault, issued a citation, arrested the guy on the spot for driving with a suspended license, got the car impounded, and made it really hard for the insurance company to fight your claim.
