4th gen rear gears in 3rd gen axel?

Axle/Gears: 3.08 non-posi
4th gen rear gears in 3rd gen axel?
Can i swap out my 3.08's in my 3rd gen (non posi rear) with my 3.42's in the 4th gen (posi) i also want to use the posi unit. Is this possible or do i have to buy different gears and posi?
The 4th gen rear is 2" longer on each side and will cause my tires to stick out past the fenders. This wouldnt normally be a problem but in NY its illegal.
