They're 3/8"-16.
That size should get about 30 - 35 ft-lbs, no matter what chunk of metal they happen go through or into.
40 is OK even if slightly on the high side. I would NOT torque a bolt that small to 45 ft-lbs unless it was SPECIFICALLY a torque-to-yield part, which those are NOT.
