Cold tranny wont shift.. need help

Cold tranny wont shift.. need help

ok so about a year ago i had my transmission rebuilt @ 98 1/2 k miles. it is now a little under 104k and i had my heads re surfaced due to car over heating and oil mixing with water. the car sat for about 4 months before i was able to get the work done and now after i fixed it my transmission doesnt shift during the first time of the day i drive it. my problem is that when i put it in gear and tap the gas lightly the car revs really high before trying to shift but it is barely even moving. once it shifts 2nd gear is fine till it wants to shift the third. it then revs to about 4.5k and starts to hop between 3.5k and 4.5k on the tach and the car jerks till it shifts. then same for 3rd to fourth. after i drive around a mile it starts to shift fine and smooth for the rest of the day until i park it for the night. then next morning same procedure.
the cars in the shop that rebuilt my transmission and he said i should have changed the oil at 3 months and 6 months after that. now when i got the car back in august 2011 he never mentioned having to change the fluids. i have been to the shop around 6 times since august for transmission related stuff. first was my mph tach went out the next day after i got it back and he charged me 60 bucks to fix, then i had to get my cable re positioned due to it being loose, then a month later same thing, and a month after that the transmission started leaking so i had them tighten up the bolts. all those times i went he never mentioned a service update.
now he wants 80 bucks for an oil change i didnt even tell him to do all still under his 1 year warranty 12k mile warranty.
what should i do? and how do i know the oil change will even fix my problem?
last thing i want is to fork up another 800 bucks to the guy for rebuilding the transmission again. thanks for the help- aaron

Get the transmission up to temperature and then drain out the fluid you may have water in the unit wich causes issues. Look at the color/condition of the fluid. nice clean red fluid.
Should be real easy to change with some ramps or a jack, takes 2.5 quarts of ATF Dexron , Synthetic is good too.
