[MN] New Hurst Dual Gate 2 Shifter #292000
Re: New Hurst Dual Gate 2 Shifter #292000
Here you go - you find it and then I will rename it to SHIFT/GATE, H/GATE or WATER/GATE - the words are trivial! Joe should have just bought one becuase now I would not even deal with him... He had no interest.

Re: New Hurst Dual Gate 2 Shifter #292000
If you knew what your talking about The Parts Place bought all the spart parts hurst had before Mr Gasket sold it to B&M.. The Parts Place Owns rights to the hurst name & Products/Parts and sole ownership to reproduce the dual/gate shifter.
So in other words The Parts Place are partners with B&M.
So in other words The Parts Place are partners with B&M.
It is possible that you are telling the truth to the best of your knowledge but if that were the case.... why are ANY numbers associated with Hurst going to Joe? Why is it that Joe is not the distributor exclusively for Hurst. I think Joe is telling you one thing and has some relationship with B & M but they are NOT exclusive partners, Joe simply is referred to through B & M as having the old parts from Hurst (Mr. Gasket). Call B & M tomorrow after you call Joe and see if they are partners. B & M owns the name HURST, not Joe or thepartsplaceinc.com - Call Joe and he can call me or have the attorneys that OWN HURST with B & M call me and I can work out a deal to reproduce them, Joe can't do it since he or his people don't even have one nor are they willing to work with someone who was willing to help. I didn't even care about lending one to him but he said he needs to own it. Great, own one but I am not going to sell it to him for $400 like he thought. I think you really feel as if Jow cares. See what he says and we'll see tomorrow.
AGAIN: Sell him yours and get the ball rolling

Re: New Hurst Dual Gate 2 Shifter #292000
Well, you did it - not really - I am producing plates and they are for personal use right now.... When I sell them, then Joe can try and go after me.... However, I think it will cost him more and I have friends all over the World. If I want to sell these on eBay, I will send them to a friend in Austrailia or the U.K. and have him sell them. Is Joe financially setup to play International Law? I have all the answers - just get your shifter to Joe and show that you were serious about havig them reproduced. The only reason I am giving the 100% effort is becuase you and Joe can't get your head out of your butt to make something happen.

Re: New Hurst Dual Gate 2 Shifter #292000
Yes, it was you and thank you for alerting me they existed. In just under a month I have aquired 3. If Joe had interest I think he could have gotten at least one of them. You say you hae 2 - why doesn't Jooe have one of yours yet? You sent one supposedly??? Then you asked others that Joe was looking for one. I called him when I got the first one to try to help out. I am not scared in the least bit and PM me and I will call Joe after you talk to him. I would MUCH rather have the liability and responsibility on Joe. Get him pissed and rialed up. Maybe then, between the two of you, you will do soemthing other than talk. 90% sweat 10% talk! I have gotten this far in a couple weeks! You have been here (on thirdgen.org) for 2 1/2 years! I have been here for 2 months!

I was just contacted by The Parts Place.
B&M and The Parts Place work together on their Hurst Shifter line.
They said they would need a complete Hurst Dual Gate 2 Shifter to see if they could put one together with their spare parts or maybe use someones to see if they can reproduce the parts.

It's easy to say that when both of you are sitting on the sideline's doing nothing to help the reproduction get started...

They have been trying to locate a complete shifter.
When Hurst was sold they didn't keep one or the plans to build one.
I sent people to them that had a complete shifter but, they never contacted them. So, I located a new one in the box and have it...So, I will contact them this week and see what they say...If they reproduced the shifter it would be 6-12 months before you could order it again.

I talked to Joe at "The Parts Place" he wants me to ship out my shifter to them in a week. Because they are getting ready to do a show right now. They have been waiting for the other people, I told them about that have complete shifters to call them back but they never did....
B&M the current owner of Hurst gave
"The Parts Place" the green light to
reproduce it if they want too.

\My thoughts again - (I did ommit one post of yours). Now with all this people needing to help and BS from you about not making the effort; you now want me to stop progress so you can slowly give your shifter to Joe, so he can MAYBE have one produced in 6-12 months AFTER you finally take him yours? Are you insane? You just posted today that B & M and thepartsplaceinc.com are partners but then he got permissoin from them to reproduce them "if he wanted to"? I don't put a lot of wieght in anything you say.
First you want everyone to provide Joe a shifter.
No one does so you tell everyone they aren't helping.
You aquire one but have now waited 3 months to do anything with it?
Then I get one and I call Joe with really great intentions and he tell me they needs to own it and he is willing to pay somehwere between $300 -$400 for it but in the same conversation I ask him what they are going to sell for - somewhere aorund $499 to $699. I told him, I am not willing to let him destroy a NOS one in the box for that and he proceeded to tell me they were in no rush.
You two need to tlk tomorrow, You need to send him your shifter and have him send you $300 for it. Then once they are reproduced, you can replace your NOS one with a reproduction for only $300 additional. You have got to be a fool! Good luck with your endevor and I wil deal with Joe. All he needs to do is pay the price to be EXCLUSIVE with B & M on these shifter before I do at this point! I did this because two people - 1991-RS being slow and dragging this out and Joe for not just paying a fair price and working with me. Geez- a used one would be much easier to destroy than a NOS! You are possibly as arrogant and ignorant as Joe.

Re: New Hurst Dual Gate 2 Shifter #292000
Well you have that one wrong in Delaware. A guy named Steve. $300 in the box... I got hosed for sure, ha ha ha. Just got another one out of California for $100 plus $17 shipping, one localy for $50... and the one form here (or eBay) that others wanted. I knew I would push forward - I haven't had much issue. What is your EXCUSE? We know you have had quite a few of them!
Now, you are correct that, Dual Gate 2 is a Trademark. So I just need to change the engraving to anything that Hurst didn't TM. So with that said, I will use this plate for me (which Joe cannot do ANYTHING about) and change the name for others. Any ideas anyone? Thank you for the help 1991-RS. I will still be working on B & M to get the rights, then I can make them exactly, if not, I will make the same look for 1/2 the price or you can have Dual/Gate and Hurst engraved for $300 more form Joe. You sure are a BIG HELP 1991-RS

Re: New Hurst Dual Gate 2 Shifter #292000
Here are the NOS ones in the box - it does have TM by the name. Now I have to research to see if Mr. Gasket, B & M or thepartspalceinc.com kept the payment up on the trademark. They do not last forever unless you refile and make the payments. If it expires you cannot revive such name.... I will almost lay money it has expired but thank you for helping out with this question. I looked it up and nothing, I will call tomorrow. I might just not be able to use Hurst. I will do my work, you do yours.
Here is my proof of the goods, yes that is the used one in the background
- you have seen my progress - now where is yours and Joe's?

Re: New Hurst Dual Gate 2 Shifter #292000
A little more info for 1991-RS and JOE at thepartsplaceinc.com. Your ducks should be all lined up before these threats. I bet Joe does not even know the answer to this since he does not own anything but a bunch of old parts. Joe is trying to be the first to market since I do know one other company who wants to make these too. Hurst hsould be the only thing Registered. Mr. Gasket would have been the ones to keep the Dual/Gate name alive, not B & M and Mr. Gasket quit the manufacturing of the Dual Gate 2. I'll find out from the trademark office.
DOES MY REGISTRATION EVER EXPIRE?
Yes. Subject to the filing of §8 Declarations and §9 Applications for Renewal, federal trademark registrations issued on or after November 16, 1989, remain in force for 10 years, and may be renewed for 10-year periods. Trademark registrations issued or renewed prior to November 16, 1989 remain in force for 20 years, and may be renewed for 10-year periods.
HOW DO I RENEW MY TRADEMARK REGISTRATION?
To renew a federal trademark registration, you must file an Application for Renewal under §9 of the Trademark Act, 15 U.S.C. §1059 in conjunction with a §8 Declaration. See the answer below.
IS THERE A SPECIFIC TIME PERIOD FOR FILING A §9 RENEWAL APPLICATION?
Yes. The owner must file a Declaration of Use (or Excusable Nonuse) and an Application for Renewal between the 9th and 10th years after the registration date. See 15 U.S.C. § 1059. NOTE regarding Grace Period Filings: The above documents will be accepted as timely if filed within six months after the deadlines listed above with the payment of an additional fee. The USPTO has no authority to waive or extend the deadline for filing a proper §9 Renewal Application. Registrations cancelled due to the failure to file a §9 Renewal Application cannot be reinstated or "revived." A new application to pursue registration of the mark again must be filed.
Because the time period for filing the 10-year §8 Declaration coincides with the filing of a §9 Renewal Application, the USPTO created a form entitled "Combined Declaration of Use in Commerce & Application for Renewal of Registration of a Mark Under Sections 8 & 9" ("combined form"). As noted above, the filing of timely §8 Declarations are required to avoid the cancellation of a registration.

Rare BMX just stop responding to 1991 RS's posts as well as anybody else's negative posts. All of your hard work at getting this to this stage is appreciated by those of us you want these. Until a lawyer contacts you don't worry about their empty threats. And 1991 RS "JUST GO AWAY" if you cant say anything nice don't say anything. BOOHOOHOO I am going to tell on you!!!!!!
Re: New Hurst Dual Gate 2 Shifter #292000
Rarebmx: why don't you start your own thread and name your shifter what you want? why are you highjacking a thread and trying to steal a trademarked item? You say your not stealing it but hurst shifter is a trademark product. The item this post is trying to get reproduced is the Hurst Dual / Gate 2 shifter ...Not Rarebmx copy shifter.
START YOUR OWN THREAD !!
P.S ALL THE PEOPLE INTERESTED IN RAREBMX SHIFTER GO AWAY...
THIS THREAD IS NOT ABOUT A COPY CAT SHIFTER...

I gotta admit......rarebmx is hustling to make this happen. If he posts a new thread....I'm following. Before he started posting his progress, this thread was essentially dead. It was a bunch of people wanting one, with no one swiftly working to make it happen.
Keep up the good work man......we just want a quality shifter at a reasonable price. Whoever makes it doesn't matter to me.

So this is about a thread FOR YOU not a Shifter for all? You can have your NO PROGRESS HOT AIR thread. I guess Joe didn't have much to say? I will start my own thread/website about the progress & won't cloudy up your thread about something you can't make happen.

Re: New Hurst Dual Gate 2 Shifter #292000
OK, I had my rubbing here / rarebmx and I was a bit miffed (well a lot) because I didn't get the shifter but you can't accuse him of not making a lot of effort. PErsonally I'd like an original shifter but the new plates do look good.
rarebmx, are all your shifters different??

What Rarebxm does not understand is Hurst (B&M) owns the patent on the dual gate shifter. He needs to make a complete shifter & cover to make it his own design. Good luck with your shifter and thread rarebmx.

This is kinda like the patent... Im talking about.
Rarebmx can't copy it and call it his own. http://www.google.com/patents/US4515033

If you make your own thread or website can you link it here or PM me the link. I am interested in following it. I am very interested in one of these shifters and think what you have done so far looks excellent. I contacted the parts place several weeks back and they sounded as if they had no solid plans for making this shifter for our application.
1991 RS - where are you / The Parts Place in the process of remanufacturing this shifter?

If you took the time to read the thread..I moved and it states that in the thread.. Pull up your panties! If it's not going fast enough for you buy one of Rarebmx shifters..
Re: New Hurst Dual Gate 2 Shifter #292000
Here's a little help for the people that don't think this is moving fast enough. There is a company out there that makes a conversion kit that you can turn a older hurst dual gate into a overdrive unit. But you would need rarebmx make you a cover. The conversion cost $125
P.S Rarebxm
If you make them a cover, I would use your own name on the cover to save your butt from being sued.

One of the companies that make the conversion is www.shiftworks.com
You will need to do some modifying on brackets and have a cover made.
Or put it in the #292001 model dual gate shifter that is the same as the #292000 but just doesn't have overdrive.

Re: New Hurst Dual Gate 2 Shifter #292000
I will make a slight change to my plates and cover the Dual/Gate (hope B&M doesn't come after all of us for typing this, since it is trademarked that way) issue. I will just remove the /, then I am good. Maybe I will put in a dash - or no space between them Dual-Gate or DualGate.... ha ha.
Re: New Hurst Dual Gate 2 Shifter #292000
The Parts Place Is the only one who have permission from B&M to reproduce the true "Hurst Dual Gate 2 Shifter"..If you want to reproduce one kind of like it go ahead but it will not be a "Hurst Dual Gate 2 Shifter"..And when you go to patent your shifter you will find out B&M owns the patent so go for it waste your time and money and when they sue you remember you were warned. So why are you posting your non hurst dual gate 2 shifter on a thread thats a list of people looking for a "True Hurst Dual/Gate 2" reproduction shifter?

I am done on your thread... good luck.
Re: New Hurst Dual Gate 2 Shifter #292000
Thanks for stop posting your shifter here and good luck with it.
Remember it's not up to you to say when reproduction starts just like its not up to other people to tell you when production starts on your shifter.

Re: New Hurst Dual Gate 2 Shifter #292000
great thread.... So 1991-RS in a week have you gotten one of the two shifters you had over to thepartsplace or is this just a thread full of BS by you???
For those interested - I am going to be selling one of mine this week. I do not need 4 of them, just one and since 1991-RS doesn't want them made by anyone but JOE - he is off the list of potential buyers and so is Joe. I might throw one up on eBay but as a last resort. I have two used and two NOS in the box. I am only going to let one go for now.

Re: New Hurst Dual Gate 2 Shifter #292000
I didn't set the price on the last one, he asked 160 and then 200, why should I run up the price? I paid what he wanted, even after he originally sold it to me for 160. Should have sent it to me for the 200 I paid. Then he sold it for 350 and didn't even give me the chance to counter offer (even though I had already paid for it) it was all BS on his part, not mine. Check my feedback, I don't clown around.
How much for the NOS??

I can vouch for Erick (Twin_Turbo) he purchased some procharger stuff from me and he pays promptly. He is a good guy.
