when my car is cold works fine goes right into drive after it gets good and warmed uped and i pull it back into drive it feels and sounds like it is kicking in and out of gear doesn't do it in reverse just in drive at a stop if im moving and slip it into neutral and pull it back its fine could it be the torque converter?

Sounds like you might be losing line pressure once the oil warms up. That could be due to many things, from the pump to seals, pressure regulator, accumulators, etc.
