Technical Philosophy Question?
Ok heres whats up were i live we have a Homeowners accociation which regluates what you can and cant do to your house etc. Well one of there rules i cant work on my car in the grauge with the door open so if im adjusting something and need the engine on ill be dead. Well ive been written up for this the next time they see me workign on my car i get fined. We had a meeting and they told me basicly "IF WE SEE YOU WORKING ON YOUR CAR WE WILL FINE YOU" im liek let me read the rules for this so i ead it and was all oh ok. hers what it says. "NO REPAIR, MAINTENANCE OR RESTORATION OF ANY VEHICLE MY BE CONDUCTED WITHIN THE PROJECT, EXCEPT WITHIN THE GRAGE OF THE RESIDENCE WHEN THE GRAGE DOOR IS CLOSED." Well last night i thoght of a loophole and at the meeting i said i would take this to sacramento becasue they are the idots who write these. Ok my loophole
When i work on my car i will say im modafiing it because a modafacation isnt Repair i see repair as fixing something broken modafying somethign isnt fixing it. Maintenance is oilchange not a modafacation. And restoration is fixing a car like buildign the engiene body work all that. The llaw no were in there states Working on the car just has those 3 rules do you think i can make something out of this. I got introuble for installing a stereo in my car wait thats another modafacation not repair maintence or restoration. What do you guys think ive been dealing with this for a year and am finly fed up with there bull****. One of the peopel on the Homeowners board was all Go to a park and do your oilchange and car work there hmm leme think ILLEGAL. Then they are we know of good mechanics well 1 i have one that i let do stuff i knwo i cant do and 2 i cant afford labor so i do most my crap my self. ok im doneventing what do you guys think i woudl like as much input as possible

repair-To restore to sound condition after damage or injury; fix: repaired the broken watch. To set right; remedy: repair an oversight. To renew or revitalize. To make up for or compensate for (a loss or wrong, for example).
maintenance- The act of maintaining or the state of being maintained: the maintenance of family traditions. The work of keeping something in proper condition; upkeep. Provision of support or livelihood. Means of support or livelihood: an income that barely provided maintenance.
restorationAn act of restoringAn instance of restoring or of being restored
The state of being restored. Something, such as a renovated building, that has been restored.
So you're not TECHNICALLY doin any of those 3.

I think you found the loophole. But try to work with your garage closed, most of the things you do to your car doesnt require it to be running. Timing check, vacuum leak checks, exhaust leaks could be done at a park.
I don't think your going to win that one.
Me, I'd park in front of the next association meeting with my hood up and tell them I was letting my car cool down, it overheated.
For now you could go and get a length of dyer hose and tape that over your exhaust tips and run the other end out of the garage. Prop the door open with a brick so it doesn't smoosh the hose.

they said i couldnt even have the grague door open a inch. Also they are its not with us its the state well people tend to overlook things i mean the people on the board are in there 60's and have nothin better to do then complain
I'd say that's a pretty long shot. For example, you might call repainting your car a "modification", if you changed colors, since you've "modified" the color of the car. But no judge is going to side with you on that, since "repair, maintenance or restoration" clearly indicates that the intent is to restrict all work on vehicles to closed garages. Sorry.
I'm curious about the statement that it's the state behind this. Generally, the original developer of a housing development draws up the covenants and attachs them to the deed of each house. In that sense, once the deed is recorded, the covenants become legally binding on each successive owner. BUT, the purpose of a POA (property owner's association) is not only to enforce these, but also to consider requests to modify or even eliminate them. Sounds like you don't have much hope there either, but it's worth looking into.

Man, that's insane. I hate the concept of a home-owner's association- what's the point of owning a house? But then again, your family -did- sign the contract...
Would they let you put up a "privacy fence" surrounding your driveway? That way you could have the door open & nobody would see the door open. Or, what about one of those "portable garages" that looks like a tent? Would they let that go on the driveway to "extend" your garage? Eh, probably not.
And if they won't let you have the garage door open (for exhaust), if that's your real concern, then just blow a hole in the garage door. Hang the exhaust hose out of that. In fact Northern Auto Parts sells an exhaust hose kit, and if I recall correctly, they also sell a "trap door" for the hose to go thru a garage door.

they didnt want to help me much when i was in the meeting also tom p Driveway waht driveway lol its pretty much street 3 inch curb grague door
They can't stop you from having your garage door open while your car is warming up. If they look in and see you working on it, then push the issue of why are they looking into your garage through a 3" crack at the bottom? That would be invasion of privacy and there are laws about that stuff. A peeping tom is a peeping tom. It doesn't matter if it's a garage or your bedroom. It's your home and you have the right to do what you want inside and out of view. If it persists after you complain about their peeping that would be grounds for a lawsuit.
Pick your battles, you can't win on the modification vs. repair but you can win on what your doing in the garage with the door open 3".

thats very true. Also i awalys thoght a Grague is a Grague and you own it and can do what eva but no i cant have the grage door open. oh ya and i cant park infront of it either. according to the RULES
Using TomP's idea ... you could install an outside dryer vent in the garage door or garage wall and pipe the exhaust out through it.
The obvious fix is to sue the association and get them to change the rules or make you exempt. Maybe you could even claim that working on your car is essential to your mental well being and you are being denied a reasonable persuit of happiness.
What if you employed a large object to block the view of your car while the door was open (such as a matress and box springs leaned up against the back of your car).
Or you could take vengance and study every detail of the homeowners agreement then use it against everyone else by agressively complaining about every minor violation that other people make.
I feel bad for you ...

You can too have your garage door open while your car is warming up. They can not require you to do anything that would cause you to endanger your health. Carbon monoxide kills, that means you need to vent your garage while it warms up. Prop the door open 3" with a brick and tell them to kiss your butt. I've been down this road before, How are they going to know what your doing in there without looking through the crack or a window? Hello car 54! That's not legal in the state of CA. File a report of a peeping tom with the local PD, get a picture of the offending association snitch and demand charges be pressed. Read your rules booklet on what you actually own. Do you own the walkway in front of the window (If there is one). If you do and they come on to it to look through the window, thats trespassing and invasion of privacy. You can't fight the rules, you can use the laws. My mother in law was told she had to sell her home by her association. She tried to fight it, and lost. Ok, fine. I told her to place a small for sale by owner sign in the side window and ask for $250,000/Firm. It's only worth $26,000. 4 years later the house still hasn't sold, she hasn't even got an offer.

basicly anythign outside is the homeowners get this the people who have driveways guess whos inchare you frkein guessed it the homeowners. Can you park in the driveway no. Its stupid. like i jsut want this one rule cuz allot of people cant afford to go to a shop. I should buy the words uglyest vcar and park it in my outside parkingspot and say its my car have no hood on it lol=) i liked it when we first moved here 2 years ago we could work on our cars and do what ever but then the homeowners is made it sux and the dude who sniches on me is my neighbor.
And this is why I don't live, nor ever will live somewhere with Homeowner's ASSociation. However, one of my friends does live in such a neighborhood. And he enjoys me coming over, because I make it a habit to annoy everyone, and then they come knocking on his door, I answer it, say, "I don't live here, get the f@ck on somewhere with your rules, and no, I'm not moving my car from in front of the curb." and slam the door. And, of course, when I leave, there's always the customary "Goodbye burnout" which tends to make people mad, because the pavement is LOUD there.
One time, at about 11:00 at night, we even unbolted our exhaust pipes from the cat, left them hanging there, and rode around in first gear, standing on the gas, then letting off... man, I know that was annoying
And if you haven't figured it out, he hates Homeowner's too.... I'm surprised we haven't had the cops called on us more times than we have...

Man that sucks. I lived in simi
no home owners assosiation crap where I lived.
I would just try to make peace with your neighbors so they cut you some slack. If that fails wage war. Do the old geezers have motor homes? They should after all thier old. What does the covanet say about that? I like the loop hole ideas but i dont think they will work. If they dont want to play nice just fight fire with fire after all thier old and get tired easy Good Luck man.
