Help with FedEX Freight + 3rd Gen Resource

I was hoping maybe someone here has had a similar experience, and could offer some insight on the situation.

I recently purchased the following items from 3rd Gen Resource:
Passenger Fender (new)
Front Bumper (new)
Passenger Headlight Fasia (used)
Passenger Feder GFX (new)

everything in the order was perfect except for the Fender! Which is slightly contorted, and has about 10 small dents along the top, where either the crate was tossed around, slid around, or some other crate laid against it during shipment. These aren't so bad, but the fact that the fender is slightly bent, where a noticeable dent in the middle of the fender is, really ticks me off. I also had no way of examining the package right away, as it was in a crate. I doubt the FedEx guys had all day for me to dig through all this stuff.

First I called up 3rd Gen Resource, where they pretty much told me Sorry but there's nothing ANYONE can do for you. I was really confused because I thought companies had an interest in making their customers happy. I guess I was wrong.

Then I proceeded to call FedEX Freight anyways, and I set up a claim on the damages. Well after waiting about 30 days, I finally get a letter in the mail saying this:

"Thank you for having selected FedEx Freight East....The Investigation of your claim is now complete. Please review the item(s) below to indicate the reason your claim has been most respectfully declined.

Our records indicate we recieved this freight in apparent good order. Delivery was accomplished in the same apparent good order, per the attached copy of our delivery receipt, which carries no exceptions.

We hope you understand...."

So as it stands now, I'm out about 269 bucks, the price of the fender and the shipping along with it... Fedex would not even refund that amount!

Any ideas guys? I might just have to walk into the FedEx Freight near me with the fender and just lay it on the desk and say, ITS YOURS TAKE IT! see what she does then.

I really appreciate 3rd Gen Resource's willingness to help, and their drive to please their customers. I really wonder sometimes how much repeat business they get. I wish I had just gone to a junk yard now

Thanks in advance.

-Steven

Sorry about your luck.

First and foremost, I can tell you that I sympathize with you. I understand the pressure you probably felt to hurry up and sign that shipper when your parts showed up. That being said, since you did sign the shipper (which states that the parts were received in acceptable condition), you have no way to recoup your losses. In the future, always inspect the parts thoroughly before signing anything. That truck driver can sit and wait while you do your inspection. If not, then he/she can leave with an unsigned copy of the receipt. I know this isn’t what you wanted to hear – sorry.

hrm

does it matter, but it was never ACTUALLY delivered to me... I had to go and pick it up from the FedEx place 20 miles from here. And on the claim form there was a spot for "Concealed Damage" or internal damage. I mean what would happen if FedEx delivered a Compaq computer to someone, and it looked perfect on the outside, but vibration and abuse caused the motherboard to break loose from the case, things like that? Seems that FedEx would be responsible, even though there is no way to check that on the spot.

I agree completely. I do this all the time, especially with items I must sign for or insured parts. I've never had a FedEx employee particularly mind me inspecting my packages. Your signature seals the deal.

Sorry to hear about your bad luck.

Might be worth getting an estimate on what a good bodyshop would charge to fix the fender. This might not be as expensive as getting another fender.

When my RS was totaled the left fender was messed pretty bad and the right was wasted. The body shop was able to save the left one for a fraction of what replacement would have cost.

I suggest you talk to a lawer. You ordered something, it arrived damaged, you paid for it, and suddenly theres nothing they can do?

See if they will replace the part for you if you pay for shipping charges. I know, it sounds stupid but atleast you would get a new fender. Better than nothing. This ofcourse, is a last resort. Otherwise, call up the Better Business Bureau and see if #1, Third Gen Res. has been listed before for problems like this, #2, see what they recommend for both companies, TGR and Fed Ex. Sounds like you got a bum deal if all of the facts are right. Also, i must say, i have never signed for anything UPS has dropped off here, they just leave it! I know Fed Ex always drops stuff off if someone is here and if its me, i always look things over before i take them and sign. Its a shame but you really have to cover your own *** with everything! good luck

i work for fed ex ground and imagining freight is the same thing but with bigger packages. Packages get tossed around but nothing to the extent of being able to bend a fender. Theres a certain way to stack boxes to prevent load damage. If the crate was damaged as well, some dumb employee wasnt doing their job right. If the crate wasnt damaged to any extent, it might have been bad to begin with.

Update

Well I gave up... I called everyone I could think of. I called like five different people at FedEx and got the run around, and basically I just ended up arguing with one of the claims people. She said that no matter what they could not help me since I signed that paper. Kinda crappy.... She did tell me though that what most likely happened is that Third Gen Resource packed it wrong, and I would partially agree with it. I think that the wooden crate is responsible for the dents.. but they still must have sat something on it.

So for now I just put the dented fender on and I know some people maybe I can get a body shop to fix her up when I get it painted.

And also, AFTERMARKET parts SUCK! I had to drill about 30 different holes. It was a pain in the *** to line up the holes for the ground effects... even some obvious holes were not there. If I could go back I would just get some fenders from a junk yard... Cheaper, stronger, and fit better, even with bodywork... I hate the way the fender lines up and I paid nearly $250 bucks for it including shipping! Damn the world! Oh well......
