ok, i'll go through the whole story... 2 days after graduation from high school, i was craving these french toast sticks from Burger King... so just like any other awesome day, i go out and hop into my 87 IROC... i get them and on my usual route home, i come up to this "T" with 2 roads... now, on the "|" road, to the right, and down the "--" road a little bit there's a Pre-school. Now this morning at this preschool their having a graduation.... for the preschool kids!?!!?!!?!!.... and the parking lot is big enough for, what, 6 cars? so where does everyone park? ON THE ROAD! so at this already blinded "T", there's cars along the right side of the "--" and along BOTH sides of the "|"... for about 500 feet in both directions. so i'm like, "sh*t....well, whatever." so i'm inching out, literally, cuz i dont' wanna jump out in front of anyone. and i'm inching, and inching.. and i get about 3 feet beyond the parked cars, now, you guys above anyone else should know how damn long the noses are on these cars... so i'm trying to get a view here and it's just not working. So i look in my rear view and i say to myself, i'll just turn around. So while this thought was processing in my head, i hear tire screeches..... ok... next thing i know, some guy RAMS into the foremost part of my driver side fender and nails the frame, sends me spinning 110 degrees, ending up in the back end of a subaru that was parked on the corner (10 feet from a fire hydrant) blocking my view to the right. after all is said and done and the cops were called, i get slapped with a "Failure to stop or yield" ticket!!!!!!! No mention to ---
1.) how freakin FAST the guy was going (IN A 25MPH SCHOOL ZONE)
2.) i was legally STOPPED at a STOP SIGN
3.) the tire screeches were like 50 feet long...

you know why? because NJ law is F****ed up! and i'm a 17 year old white male driving a red camaro... that's why. Who cares if i was following the Driver's Manual. Who cares if i was legally stopped at a stop sign!? And who cares if the guy was paying attention to the road or speeding!? NO ONE.

this guys managed to send the nose of my baby 8 inches to the right, shatter the driver side t-top all over me and the road, hit the thing so hard my right fender is completely annihilated, and actually put a dent in the right quarter panel!

damn dude, I'm sorry. This is the point where having a great lawyer comes in handy. 1st, get out of the violation, and then make the guy fix it!!!

 

I would get out of that ticket, call in witnesses, get some emotional distress and then

Sorry to hear, and see, what happened to your car, man. It always amazes me how they place faults in an accident. I would definately get a lawyer. All those cars parked on the road should have been tagged while the cop had the book out to right you up, also.

 

man you must be PISSED OFF get a camera & take a photo of the other guys skid marks so you have at least some back up evidence then go talk to your legal dudes and if possible a copy of the police report if you can.

VERY GOOD idea, I would take some pictures of the skid marks

ASAP, they may come in handy while you are in court.....

Get the camera and get that done...

 

Having a sketch (or several sketches from different angles showing what you could see and what the truck could see) of the intersection wouldn't hurt either with illustrations of where you were, the parked cars were, and the direction that the truck hit you from. Make sure that it is relatively to scale as well to give the judge a better idea of what happened. Have someone qualified to testify (maybe from your insurance company, an adjuster?) that there was no way that the person that hit you could have done that much damage unless they were speeding.

 

Just a thought instead of a scetch take some photos of the intersection & have cars photoshopped in to give a realistic view of what you COULDN'T SEE.

 

The same thing happened a couple years ago with my 92 Ford Probe GT. My stepsister's bf was driving it down a side road when a rich little daddy's girl in her bmw made a wide right turn right onto his side of the road completely destroying the car and it ended up doin a 180* and slamming into a dumpster. Well the girl's parents tried blamming my stepsister's bf for it and they tried sueing us. What they didn't know was that we took pictures of the accident scene and it showed the skidmarks on his side of the street where they hit. Needless to say we won the court battle and I ended up getting $7k for the car and they let me keep it! So definately get pictures of the accident scene and maybe some witnesses. You just cant' argue the facts

I had a similar thing happen to me when I was 17. I was driving a 67 Camaro, minding my own business, and come to a road where I'm going to turn left. The traffic coming toward me in the left hand turn had a stop sign, and there was a guy in a truck coming towards me. It had been raining and the guy in the truck hits his brakes, slides about 40 feet, and slams into my ride! The cop shows up and says that I was cutting the corner and that I slid into the other guy! There were dual skid marks from the guys truck that slid through the stop sign, and the only skid marks from me were where he had hit me and PUSHED me into the grass!

I went back and took a lot of pictures of the scene, the position my car was in, and the guys skidmarks. I filed a claim against the other guys insurance company even though the report said it was my fault. I fought with them and told them I would take them to court if they didn't pay my claim, and ended up getting a settlement and painted my whole car after replacing the front fender.

Don't give up! You can WIN! Good luck, and watch out for *******s like that. I hope you are feeling OK, that looks like it really hurt!

Sounds like it would be a good idea to carry one of those disposible cameras in your car with you. That way if something happens just get out and start snapping pics. Those things don't cost about $10.00 for a really good one, and my possibly save you / win you thousands in a court of law.

Carrying a camera would be a good idea except for the fact that leaving it in your car during the summer would destroy the film. I suppose the majority of us could carry them for about 8 months out of the year though. A very good idea indeed, esp. for snapping a quick one of the @sshole's plates if they decide to drive off.

 

Man I got p!ssed just reading that! I hate to see things happen to such a nice 3rd gen. I bet the car is totalled beyond repair just because it bent the structure of the car up.

The guy that hit you had to be going over 45MPH for that type of damage that happened to your car.

As for any injuries, i has a SMALL cut on the top of my forehead for glass i guess... it was even bleeding. And some mean whiplash.

The car is pretty much totaled... the CAR. A lot of the stuff on it is still great. Int, Engine, Trans.. rear, all the good stuff...and thank *** that my wheels are fine.... I think that 85-87 IROC wheels are the coolest freakin production wheel of all time.

Did i mention i payed $800 for that IROC???, and put a new 305 in it with my bare hands?? and i was 16 at the time... the car took me a while, too... days. Days of work....all for that..

thanks guy, i pretty much have done everything i could've. you guys gave some gerat advice and thanks for your condolences... it was such a great freakin car... yeah, Adam62083, my car was out about 2-3 feet, which boggles my mind cuz on a sunny clear day, you can't see a *** damn red nose sticking out!?!?!? and when the hell was this guy doing that damn close to the parked cars?!?!?!!?!? i.... i JUST DON'T GET IT. Wel anyway, i have court next tuesday, i'll tell you all how it goes.
As for the car situation, i just picked up a 91 Z28, blue, 305 -speed density setup, it has a hard knock in the engine... $1200 , hopefully i'll have better luck with this one... and it's almost a step-up. Less miles, younger model, i can supercharge it. Anyway, i'm just trying to get some of my sanity back

hahaha, my dad brought this POS home from somewhere... it's got 2 hydrolic arms that come up, picks up the back of the car via the rear... It's heavy as hell and we NEVER used it... so that's where it's sitting.......

My 85 SC got hit in almost the same place, from the damage I would say that the guy was moving 35 to 40 at the time he hit you, definately speeding.

 

How the F#ck is 80% of it your fault? You stopped, you slowly inched forward to see around the cars that were undoubtedly illeagly parked and some jack asz doing 50mph plows into you. Quite frankly it should be a bit differant, i would say 5% on you for not turning around sooner (just to be kinda fair, give you a little responsiblity) about 50% on the cars and 45% on the other driver. Quite frankly they should have ticketed every car parked out there and the jack *** that hit you who was obviously going to fast. Good luck on fighting it, i would say if you can get pictures of the tire marks and maybe get a few friends to park on the side of that road and take a picture of it to give the judge a good idea of what it was like, plus pictures of the damage to your car and a good side shot of a third gen to show the length of the nose, you could probably get out of the ticket and probably get the insurance to pay for the damages to your car.

 

Yeah be sure to SUE the shyt out of whoever hit you. Whatever happens in Criminal Court, if you're not happy you can always pursue (hehe he said SUE) it in Civil Court. Be sure to go take pictures of the accident scene before anything gets cleaned up (be sure to get those skid marks and take a pic of the posted 25 mph speed limit sign). Always sucks when this kind of stuff happens but if you cover your bases then you wont get screwed and before you know it you'll be insuranced out and driving a 92 z28!! Hope it all works out.

 

Seeing as how you drive well, drove an IROC and a male, the law doesn't give you the benefit of the doubt unless you had video or eye witness evidence. If only you didn't have a craving for those french toast sticks that day. I understand where you are coming from with having to inch out due to the long nose. I wish I could help. In florida as I learned a car can be parked illegally but it is still your fault because it is parked. I was parked by a dumpster because there were no spaces. It was illegal, but the lady with a van backed into me. Her insurance had to pay even though I was not in a legal spot.

 

Yup, that's true...........even if you are breaking the law people still have a responsibility to go around you without causing you any harm....

For instance somebody trespassing on your property and gets hurt due to un-safe conditions can still Sue you.........

 

I've had similar things happen to me in the past, just not to that degree.

I took a few law classes in school, and to be honest, the cop's ticket will only affect you so much. Get a lawyer - with the evidence, I'm sure one will take your case.

Its the COURT that you have to convince - not the cop. The cop was probably sick of teenagers in sports cars. Use that to your advantage!

Definitely get photos! A picture really is worth 1,000 words. Explain it exactly as you did to us, because you were the ONLY one not at fault there.

You may be able to sue the preschool, the cop, the driver of the truck, maybe someone else too ;-)

I'm not a fan of over sueing, but you were definitely wronged!!

 

Oh, I forgot - if you're insurance goes up, you can probably sue someone about that too (whether its the other person to pay for it, or your insurance company itself - if you're found not at fault).

If you have yet to take pics, make sure you use something as a gague. The pics can make the skid marks longer/shorter than they really are. Get a tape messure out and if the skid mark is long enough and still very well there, depending on traffic, have somebody lay down next to the marks. That will make a big difference. Also get about 4 quotes from auto shops on the repair. Sorry to hear about your car, hope it gets fixed and back to square one. Keep us posted.
