Yeah cop came up to me with lights on asked me what are you doing answered him politely taking picture of my car. He goes "get in your car and get me your license and registration" I start to get a lil pissed now. i give it to him he goes back to his squad car. 1 minute later no joke he comes back throws my papers inside my and as he's walking away he's saying "im letting you go with a warning". i Started to laugh. He turn off his lights and wiped his car around shooting rocks and crap against my car i got pissed. hes lucky i didn't get my car painted and i didn't get his number wish i did. He was gonna write it up for trespassing on private property nothing about o might be a terrorist threat

That sucks man...if it was me I would never have given him any information until he told me what I was doing wrong. Unless you are breaking the law somehow you don't have to tell a cop anything. You can refuse to give them your ID, and while they might try to be a hard @$$, they really can't do anything unless you are doing something illegal.

just being honest like you were gets you out of a lot of $hit trust me.
and last time i checked "trespassing" is illegal or did someone change a law?

Refuse to give them your ID? You need a license to drive a car, and when asked by a cop you have to show them your license. I'm guessing that if you wouldn't show them your ID, they'd figure out who you are when they're fingerprinting you at the cop shop. If they don't take you in, they have every right to not let you drive the car. No license=no driving. Then when you're walking home, chances are your car will be towed for being abandoned or parked on private property.It does suck, but do what most people do; smile, do what you're asked to do, don't get pissed, and your life will be much smoother. I can tell ya that if you get on the wrong side of a cop in your hometown, life will not be easy at all.

Well, you were trespassing on railroad property. By the way you told it, sounds like the cop could have handled it a little differently and not been a ***** about it.

Be polite, never change your story and never admit guilt. I spun out on a gravel hill once and the cop tried giving me a wreckless driving ticket. He actually gave it to me. States attorney dropped it quick enough. Another tried to give me one for "weaving in my own lane." It was 10:30 AM on Saturday. I have all kinds of police stories that are ridiculous.

Haha, cops watch the railway lines in the states? We have the CRP (Canadian Railroad Patrol) If you are caught riding a bike within 20 feet of a railroad, they are allowed to ticket you. Hell, they even give them guns.

Driving a vehicle is a privilege, not a right. Therefore, you have no rights to refuse those who are in charge of granting or removing your privilege, not to show them your ID. I mean really now!
The police, with regards to the privilege of driving and also public safety, has the right to check . . .
- does the operator (you) have a valid driver's license?
- is the car properly registered?
- is the car properly insured?
Plus they can run the license plate at any time (even without your knowledge) which also contains a wealth of information.
Also, XxSgtReillyxX89, I don't see that the officer did anything wrong. The railway and the land it sits on (which can extend quite a distance from either side of the tracks, even up to the road) is private property. While taking pictures of our rides in front of nice backdrops may seem normal to us, look at it from his point of view. His first impression is why is there a car in an unusual location? You gave him an explanation. And just to verify that nothing any more serious than tresspassing is wrong, he did a routine id/license/registration check. What's the big deal?
And since this is only 50ft from your house, I'm sure you'd be very grateful if he did the same thing to someone else and discover that the car was stolen, or the driver was drunk or he had a violent criminal background with a warrent out for his arrest, etc, etc.
I do agree that he should have been more careful driving away, but that's about all.

I was watching Michael Moore's film about a guy testing too high on the Wonderlick (SP) test and the police in this one town did not want to hire him. They said that he would get bored with the "duties' that every cop has to do every day.
Basically, it boiled down to intelligence. I thought it was interesting, but I am sure the cop guys on here will get on my *** about this.
Still, even though this story might not apply everywhere, it still puts some perspective to why certain cops act a certain way.

The way I see it Iroctopless is that the cop was trying to flew his muscles. Yes, the police officer has every right to ask for Drivers License, Proof of Insurance, and Registration, but it was totally uncalled-for for him to though the papers back at him and take off like he did, and it was in very bad taste that he threatened him with a ticket.
I would call the Police Department and inform them of the events that happened.
I know we all say "I wouldn't have given him ****!" or "I'd kill him if he did that to my car", hell I'm guilty of it myself. But when it comes down to pulling out a gun and shooting the officer because of something non life threatening like that or telling him to shove it up his ***, I can guarantee that none of you would do it.

Failure to ID yourself, is an offense. Failure to obey an officer, is an offense. Simply asking for your info, is not out of his jurisdiction. He has the LEGAL right, to see your ID, before telling you ANYTHING, like why he wants it. Try it sometime...post again when you get you released afterwards! LOL
Now, there are things he CAN't do, without cause, but asking for ID, is NOT one of them. No way. Now how. EVER.

yep cops can do as they please. I was pulled at 5am (empty streets in my town going to work and wasn't speeding) for a loud exhaust. I was pissed cause it was 2.8, converter in operating condition and a mellow flowmaster. Cop was a **** saying my muffler was nowhere street legal, I got pissed and argued, he's like sign the ticket, I'm like that is an admission of guilt and I'm not signing nothing, he says sign it or go to jail then sign it, I was like do what you have to do, I'm not signing it. He wadded it up, threw it in my face and says I'll see you in court. After about a month of harassment by what seemed like the whole friggin town, I do mean harassment( I was pulled in my own driveway, no ****) I took it off, went to court thinkiing it would be dropped for complying with the law. Wrong, he has this story of white camaro blazing by sounding like a race car, spilled his coffee lmao it "startled" him. He threw in he made sure I heard it really good when he left, I looked at the judge and told him it wasn't loud, and it was obvious the officer had no intentions of letting me go, threatend jail yada yada yada, what else could he do to me for holding it at redline for about 20 seconds. I already had a ticket for it (double jeopardy) Anyway later I find out this "officer" is the chief of police. **** runs downhill and I started at the top. The harassment was that exact thing, every officer under him was assigned to me just because I pissed him off. Moral to this rambling..........yes sir, yes sir, yes sir, yes sir.

I didn't like the fact that he sprayed debry when he drove away, but I addressed that point when I stated, "I do agree that he should have been more careful driving away, but that's about all."

But they leave **** fine Backgrounds...Northern Michigan there is a railway and in the fall the trees turn colors. It is perfect for a picture. I plan on gettign one there and infront of a barn with trees in the background for my senior pics. But when i do it near the railroad i plan on getting ahold of the local police and asking permission. The police around there are generaly pretty nice about that type of thing so we'll see.

The police will tell you to just stay off. They are pretty touchy about the issue. If you are going to ask anyone for permission, ask the railroad, afterall they own it. Although you can almost be on them giving you a big NO.

In my opinion your better off asking them before you do it anyway. I know both up north and then also around Mt. pleasant the cops are a great deal nicer and allow you to do things like that under supervision if you ask. as long as your polite and don't ruin there town, at least in my run ins there much nicer.
