I have one piece of a puzzle missing- in May of 2005, I sent MODERATOR John Doward (Doward) $950 for a partial turbo kit per this thread he posted-

I understood fully there was fabrication involved. He kept me up to date as to what was being done, then said in August of that year he had some problems with the coater that was doing the pipes, yada yada. Then in Jan of '06 he said he was "throwing in a set of headers and the turbo" for my patience. Unfortunately, he did not "throw it" in a box.

FInally in May of '06 I emailed him, basically said that I had come through on my end of the deal, had been patient, and that I either wanted my parts or my money back.

He returned my email, said he understood where I was coming from, and that he was in Japan on a study abroad program. But he had all my stuff, and would "make arrangements" to get it OR my money back. I responded- he replied THREE MONTHS later, claimed he "didn't get my email....." I FORWARDED my emails to him, told him I just wanted my money back.

DId not hear back. Researched posts, found a buddy of his who
had helped him on the project (member "Vortex") I sent him an email, told him the story, he replied that John was not like that, and he'd try and contact him but had not seen him in a long time as he had moved or something. Got an email from Doward, saying "What's up?" like he had no f'n clue WHAT WAS UP! This was a couple months ago.

He posted in September of '06 on another board (www.fuelslut.org, now defuct) that he recieved a speeding ticket in Gainesville, FL. So I know he was in the states long enough to send me stuff.

I paid him via Paypal, and have a string of PM's and emails between the two of us.

The puzzle part I am missing is a street adress. I have only a PO box in some other place, and an adress from an internet search, but I want something more concrete- I have a friend who is a sherrif's deputy who will try and get me a drivers license adress for him. He has not been online since September of '06, but I would not be suprised if he was posting under another user name. He has Gainesville, FL listed as an adress in his profile.

He is or was theoretically in Japan on a collage study abroad program- if he was in the service and was in Iraq I'd have some sympathy- but I am sick of this.

I have to go to the local courthouse and file this, but need an adress.

I guess I am just venting here and technically this did not go through the classifieds, but the guy is a frekin' MOD here and posted this as a group purchase on the V6 board!

Can anyone help me out on this?

 

Why not just call the FBI internet fraud division. Sounds like a felony to me. You should have paypal info on sending money. Could be considered a scam.

 

fbi internet fraud, lmmfao..... they ain't goona do ****, plus it even says they will try to get with you, no defanant replys.... hell when i got ripped my 3000 on ebay, those stupid ***** didn't even send a reply!

best thing to do is try to find someone local in your area, they will be more simpathetic to you and will actually give a damn, plus try your local state police, more than likely they will be able to have a better chance of tracking the puke down..... most states have a internet fraud division, plus if you look online you might be able to find a fruad investigator in your area that specializes in this....

ahh, just look at it this way, guy rips you off, chalk it up to experience, i know it sucks and stings like hell knowing that people are so low to want to blateantly steal from others, but until safer things are in place to prevent it, it will happen over and over again..

if you have his address i would start from there and track his *** down....

 

BadGTA, you are correct- the FBI has bigger fish to fry. My friend, who was a detective for a small police dept. and is now a sherrif's deputy for a larger division, told me that technically it is internet fraud, but the prosecutor won't waste their time with it because it's out of state- I'm in GA, he's in FL. However since the crime was comitted here, I can file in small claims here.

It's under $1000 so I go to magistrate court- he can be "served by registered letter" and I will have to run an ad in a local Gainesville paper (that is if he actually has an adress there) in the "public notices" section.

Chances are one of two things- he will come out of the woodwork when he gets served, or never show up. I win a judgement for my money and legal cost ($25 I think to file). Now I will never probably GET the money, but he gets a judgement that goes against his credit. My older brother is a bankruptcy attorney out in Arizona. He told me if I can get that judgement, he be sure to attatch it to all the credit reporting agencies- in other words, any time he tries to buy a new washing machine at Sears, get a credit card, mortgage a house, it will be a thorn in his side.

I'm just frustrated and trying to do whatever I can.

I have had people who live in FL say "Lets go kick his a$$!" but first off, I'm 40 with two kids and a job, I don't play that John Wayne stuff- I show up, he calls 911 and claims I "threatened him" and I'm in jail in another state with my word against his.

And of course I still don't know where he lives as far a a street adress- and he may still be in Japan.

 

What does PayPal have to say about the situation (and they only have the PO Box number also)?

And yes as far as getting him for this will be tough. A recent customer of mine had $8,000 taken in a similar manner. It was a faux e-bay ad for a motorcycle that he supposedly won. Come to find out (after a fake tracking number) the bike was real and registered to another state then it was supposed to and he can't seem to get anything done either. Good luck, hope something comes of this for you.

look at it this way, time after time, if you get ripped off it kinda becomes irratant, tiresome, and sooner or later you will get fed up with getting done dirty, and you will make a stand.

now lets take a look at what happend to me, yeah i got ripped for 3000 on ebay, i was stupid in trusting and i learned, but guess what, i'd say i was one of severeal that he did that way that week, why? because he or she is a soory no good for nothing peice of garbage who has more than likley smoked dope and has been so strung out their entire life they have to steal so they can live, because they are too sorry to get out and get a real job and have to pay taxes like everyone else in this miserable place does!

so yes, even if it meant a little court proceeding, then yes, i would find out who he is, get a round trip ticket, go to the ****ers house, beat down the door, and when he awnsered, smack! right between the ****ers eyes, i wouldn't give a damn if it was right in front of his neighbors, friends, family or not, because if a man can sit and steal money from someone without true disregaurd for his self or others then he needs his *** handed to him! plain and simple! and in kentucky, if you are a first time offender 9 out of 10 times it will lead to probated time and a slap on the wrist.... after losing 3 grand, i just don't play around anymore, and my advise to anyone on here is to be the same way, because people has got to be stopped, not just given a slap on the back, don't belive me? look up yahoo andd search internet scams and such, they are getting two to three years probation for stealing thousands of dollars,

think i would care to share the same sentance? hell no i wouldn't, at least i would know that my sentance was for somthing good and not for somthing like what they did!

If this is the same guy and i think it is i sold him and his dad a cowl hood. Seemed ok for the short time i talked with them both. They lived out in kissime,(not sure of the spelling) orlando fla area at the time.

To follow up- I ended up traveling 400 miles round trip from Savannah, GA to Gainesville, FL to file in Alachua county small claims court. The address provided by HPE proved to be no good, he had moved but I found by luck of an internet search and help from a member of Florida Thirdgen.org that he worked at Santa Fe community college- I had him served papers there.

He did not show up in court when the date came, I was awarded a bit over 1200 dollars including my court costs. I guess he wasn't enough of a man to face me and admit he did me wrong. Anyway I have a pretty much worthless piece of paper, I still have to spend more money with a collection agency to at least get this against his credit report.

He must have gotten rid of the Camaro, he is into Toyota Supras now and is a big poster on Supramania.com, where I suppose he is ripping people off over there?

Well a fireman here in RI recently did that to his neighbor. After getting punched in the face the dude shot the fireman in the chest; killing him in front of all his family and friends and is now claiming self defense. ( fireman walked up & assaulted him in his own house. )

DEAD --> during his kids birthday party. Hardly worth the 1 minute of life he had remaining after punching the dude

This is not a joke.... Use your head ! Don't be a fool and remember that money can be replaced. I hope that your efforts pay off and that this crook gets some type or retribution for ripping you off.

Actually he's a [I]former[I]moderator, after he hadn't logged in in about a year or answered his PM's they decided to give the moderator slot on that board to someone else.

He sold his Camaro and all the stuff (mine probably too) and got into Toyota Supras. He's still trolling around the central FL area somewhere. His day will come, time wounds all heels.

And you will notice I did mention in response to someone elses post about how I have a cool enough head and sense not to get physical. Life goes on.

 

You know where he works? What does your brother say about attaching his wages? When you went to court and spoke to the judge, you should have brought this fact to the judge's attention so that you could have gotten a court order to give to the college payroll department. Also, the collection agency doesn't work as your agent and try to get your funds for you. They 'buy" the debt from you for a fraction of the award and try to collect the whole amount for themselves.

In the county and state where I was awarded the decision, it does not work that way. I did not even leave there with court papers, they mail you the official paperwork with the judge's signature and rubber stamp on it.

The defendant, in this case Doward, got the same thing mailed to him. Then he was to fill out some form listing assets and income and return it to the court with a payment plan. HA! Like that happened.

Yes, I mis spoke myself using the terminology "collection agency" I called the clerk's office in that county and they said when it comes to wage garnishment I have to consult an attorney. In other words, there is a process to go through, but seeing as I live 200 miles away in another state, I would need to pay a Florida attorney to do this.

You see, it's one thing to get awarded a settlement, and one to actually collect on it. I understand the chances of seeing a dime of this money are nil, l just would like to get this against his credit as a bad debt, so I can get SOME satisfaction out of it!

But at this point, it's going to cost me even more money out of pocket than I already have spent, and do I really want to do that?
