dave mc Screwed me over ------->

This guy sells on these classified boards as well as E-Bay under " todays_classics " & " davestocool "

Here is his description:

There are no burns, cracks or damages this was tested in the car and it is working. I would give it a 91/2 out of ten the only thing keeping this from being a 10 is some very miner wear .
He was specifically asked if the cassette deck in this radio was fully functional. His reply was " Yes it's working " I buy the radio and tell him that I only paid this amount due to his previous statments about the working condition of the radio. The radio is deliverd and I take some pictures...... I test the radio and take a couple more pictures. Why ( you might ask ) am I taking pictures before even opening the box ?? 'Cause it's been over 8 years since I have found a working radio.

I dispute the purchase and he tells me to send it back for a refund. I was forced to escalate this "dispute" to a payPal "claim" because he never sent the refund - After I send it back He now claims this is not the radio he shipped me.

The Pictures show the radios backlighting is not working and CLEARLY show the cassette mechanism is engaged ( will not even ACCEPT a cassette ) and even if it would accept a cassette - I doubt it would play with all the animal dander in there. Also; one of the 4 speaker chanels disin't work. ( can't take a picture of that )

This guy took almost 2 weeks to respond to the dispute. He has never send me a message about this piece of crap. I left neg feedback for him and less than 1/2 hour later he left me feedback calling me a scammer. I Filed the Claim - not him. I waited 2 weeks for him to respond to the claim and only after not getting a response or refund did I post neg feedback based on his buisiness practices - he left neg feedback within 1/2 hour in retaliation.

He's got my $$ and now he has the radio. I'm left with an empty wallet and his insults.

EDIT ------> The DAY I FILED a PayPal Claim against him in regards to this matter he changed his UserName. He used "davestocool" for 4 1/2 years until the day I filed..... Then changed it to " todays_classics ".

works for me cept between the people in this thread we got most of NA covered lol.

what did this radio come in/out of by the way? i gotta do some scrap yard digging and ill keep an eye out for ya if i remember!

The real bitch about this is that situation is that I tried to avoid getting screwed from the start. He has decent feedback on E-Bay and I knew the guy was a ThirdGen member before I bought the radio. He seemed to have a decent reputation here and offered a refund if the thing didn't work. He was SPECIFICALLY ASKED if the tape deck was working and said "yes". In my payment notice I said " Thanx for answering the questions that get posted to you. Your respons to those questions allowed me bid higher than normal for this radio !"

I've got NO LESS than 20 of these radios here. All of them are non-functional and in need of service. I offer people a discount when they buy replacement radios if they use their broken units as a core. The repair charge on these is usually right around $100 and I paid less for his radio. I figured if the radio was in working order than I would save a few $$ compared to getting one serviced,... If it didn't work I'd be able to get a refund. Like I said - It's been a LONG TIME since I've located a working Berlinetta radio

After 10 days he finally responded to my PayPal dispute and told me to send the radio back. I read the message - got up and packed the radio; it was shipped back to him before 8am the next morning. When I logged back into PayPal a couple days later to update the dispute with the tracking numbers He said "as a seller I'm surprised about the low quality of the pictures ( the pictures shown here ) and that he couldn't tell if the radio was in fact his. ( Keep in mind now that the radio has been shipped already. ) He wrote that the same night he told me to send it back - but I didn't read it until after the radio was shipped back to him. When I wrote back with the tracking number I wrote back and told him that " As a seller yourself I can only guess that you (like many of us) mark your parts. If you mark your parts - you will see your marks on this returned unit."

The package was delivered to him before the 20 day dispute deadline ( even after his 10 day delay in responding ) and I got no refund notice - so I was forced to file a claim before the dispute deadline ended.

What possible reason would I have for shipping him one of my many dead radios ?? It's already cost me more than it would have to simply deal with my radio tech to get one serviced. ( Part + shipping twice ) Never mind the month worth of aggravation & hassle that comes with dealing with PayPal over the dispute or a black eye to my reputation and getting called a "scammer" in my Feedback. I have no problem buying parts "as is" - but when I buy something that is repeatedly claimed as "near mint" and "working" than that's what I expect to get. If you a refund is due that send the refund - don't be a scumbag.

Goes to show that no matter how hard you try to avoid problems, it will always come down to your-word-against-his. The ONLY way I can think of protecting yourself when buying online is to do everything on video tape. Set-up a recorder and open the package and plug in the parts ON TAPE because taking pictures doesn't help - at all.


84redt Thanx for the update. My 85 Berlinetta resto has taken a back seat for awhile due to the ICE storm so there's no real rush.

joshh44 My six year old heard me telling my wife about this and in true 6 Y/O fashion he spoke like the terminator and said "He needs a knuckle sandwich" - I agree.

LMSkyliner I have radios and can still find them - but finding one that WORKS is the trick !

I've seen other sellers on this site, where someone claims to have been rip off via mail, then "some people claim are honest, because they have personally purchased from them" but that's the problem. People who do rip off buyers don't have the guts or couldn't rip off some one in person because the purchaser sees what they are paying for. They can send what ever they want in the mail when it's done on the honor system.

No - I did not try calling him. I've got $100 into this deal. I filed a dispute and then E-Mailed him. Why did I file the dispute and not try to call him - because then it puts a time table on resolving the problem; 20 days. It took him 10 days to even send a response. I updated the dispute twice after first filing before he even took the time to respond. ( but it took less than 1/2 hour to retaliate with neg feedback calling me a scammer.)

I read his first response telling me to send it back - then got off the PC and packed it for shipping, he posted another message to the dispute that same night ( I didn't read it till a few days later ) and said ;

As a seller yourself I'm suppressed at the very poor quality of the pictures you sent. I cant identify that as the one I sent or one you already had.

Look at the last picture,.......... If you sent a TRUELY working radio and were SURE that it was tested before it was shipped how can you say " I can't ID that as mine or one you had ". Look at the inside of the radio - A tape could not even be placed in there and the animal fur is disgusting. I can tell you that If I ever sent someone a WORKING radio and they sent pictures of this thing claiming it was what was delivered I would be swearing that it was not mine...... and would call him on it by asking for pics where my marks were, not "I can't tell if it's mine or yours". If the radio was in fact tested than there would be no questioning it AT ALL. I also mark my parts, if he asked me for a picture of a specific part of the radio to ID it as his ( without telling me if/where he marked it ) I would have sent it. I have no reason not to clearly ID it - it's the radio he shipped me. I'm not dumb and If I were to try and burn this guy I would have picked through all the 20 or so radio's I've got to find one that closely matched his - not sent back a radio that looks like it was used as a mouse house when the radio shipped to me was supposed to be in "NEAR MINT" condition. I returned the mouse house since that's the radio I got from him. My guess is that he plugged it in - heard the radio and listed it for sale. There is NO WAY he ever tried to put a cassette deck in it and obviously didn't test it well enough to see the backlighting was out or that a rear speaker channel was dead.

I've been on both sides of this problem..... I had someone claim that something I sent them was busted when I knew it wasn't. What happened ??? I honored the buyers request for a partial refund when it was an "AS IS" sale. I didn't like it - but it was the right thing to do so I did it. This guy advertized a refund and rather than honoring it he is calling me a rip-of, I'm not cool with that.


P.S. Frank89IROC is right - had I been there to buy this radio in person He would have never made the sale. I *might* have offered him the core value of the radio. Buying in person and buying thru the mail are TOTALLY different.

I too am sorry karr, i didn't mean to write a crummy post because God knows I hate when people come down on me. I just worked a 10 hour shift last night and read ur post and I took offense ( I realize you didn't come down on me, after i posted such an ignorant post... and thats why i edited my post, i felt bad and stupid and it was my bad.) I must admit he does have some neat things and I mean he's not a bad guy, I still have to stand my ground on not liking how his business is run (but it's not my call,) he's the owner and im the consumer I have a choice to go elsewhere and i'll leave it to that. I actually am shocked that he would do something like this, also. I just judged how he runs his business with my sour grapes and John's. But oh well, I do have some space not a lot but enough to store a 57 chevy, 78 el camino, 92 camaro, and an 81 corvette.

I've got 5 Camaro's and 2 SUV"s. All the Camaro's have tags except for the 85 that I'm currently re-building.

My post here is to describe my experience with this member. I don't want anyone here to feel the need to appoligize - excpet for Dave. I'm sure that there are plenty of people that have bought stuff from this member in the past - with both Good AND Bad experiences. Everyone should feel fine about posting those experiences what ever they may be.

I've laid out the facts from my perspective and expect that Dave will be more than happy to add to the thread when he gets around to it.

Just wanted to give this a friendly bump.... he got me too over the late spring into early summer....

From now on I finally decided after thinking it over a while not to let this deadbeat get away with things... I am going to post in EVERY thread he EVER makes from now on... and if I see him reply in a thread too, well guess what - It goes there as well. Consider it a Public Service Announcement.

Near the beginning of the summer I purchased and won an auction on ebay for a never used spare tired for a 3rd gen, with hardware. Paid $40.77 through paypal. Unique Transaction ID #29V4391555258344G

After a couple weeks of no parts, I sent emails through ebay with guess what - no responses.

After a little more time of that, I filed a paypal dispute at which time and received a response that Dave was apparently under the weather and had a stint put in his heart... would I like the parts sent or a refund. Here's the text of the dispute...

I'm truly sorry for all the delays. I had a heart attack on the 22nd of April and was in the hospital for 7 days. I had to have some testing done a week latter and had to have 2 more stints put in. I had my son packaging and sending items put he was sending the wrong parts to the wrong people. I have been doing as best I can to straiten out this mess your item is packaged and will be sent outif you still want it?. I understand how you want the item you paid for. I would be freaking out myself if it was me. I appreciate your patients thanks dave
Sounded reasonable enough, so I sent him an email asking for the parts ASAP please, within what he was going through for his situation. But guess what - NO Parts ever showed up. Not only that, but the paypal dispute timed out and I could not re-open through them for unsent parts!!!

I later posted on here looking for other parts... and guess what - HE REPLIED TO MY ADS!!! I waited for him to send my his paypal account address to make sure it TRUELY was him, and sent one last reply as follows because I am willing to do business as long as I do get what's promised me, and owed me:

Interesting side note, and I figure its sort of fate that I wind up crossing paths with you here....

I was about to try and touch base with you again. How is everything going/how were you feeling? I had been in touch just before a long road trip for work because I think I won an auction from you on ebay for a never-used third gen spare/hold down package on ebay and had to leave quick when you had said you had some stint surgery that kept you from mailing it out...

Needless to say, I've been so busy and flying around that I missed getting in touch with you right away. Would it be any cheaper if these things were all shipped together? I assume you never shipped the wheel and such as I just got into town yesterday, picked up the mail/packages from the postoffice and nothing was there... let me know though, and we'll go from there.

Needless to say I never heard a response back since summertime. I had been chalking it up to getting screwed over, however, seeing he stills tries to do a brisk business on here I'm not going to take that or let others go through problems either. From this moment on, any post I see made by this man, this story will be posted under it...

i dont know where but i have read that exact same language, 9 1/2 stuff.
i also read on this board that they make good radio's for the desk, i have one i took out of my 90 cause the tape quit so i think i will try it to.

Actually, to be "fair" to both, I'll leave this thread open after I removed a few posts that did not contribute anything constructive to this.

However, any further posts in regard to moderation/staff/website, or further legal threats against our website, will be moderated and the account possibly terminated.

Obviously it's not good when any transaction has problems. However, that does not justify some of the actions and comments made (deleted). Please use common sense, and to borrow what John said, please play fair. Submitting 28 replies in threads involving the other party is not fair, but instead, is spamming the forum. Please share your story/issue in the Classifieds Feedback Forum and stick to the facts.

Thank-you and good luck to those involved.

I guess in a one sided way that some of these things are true. I deed sell a working stereo the buyer clamed it was not working. I offered a refund if the item was returned I gut back a box full of smashed parts. I deed refuse to voluntarily give a refund stated my case and let paypal do what they do. I fill that I was the one that gut ripped off on the stereo. It was wrong for him to smash it then return it knowing that paypal would give him a refund when he provided proof of return shipping.

And yes I deed have a hart attack and was off my feet for almost tow months. I hade over 200 active listing on ebay at that time. I hade 75 items end with winning bids before I hade a chance to give my son my password so he could log on and cancel any remaining active listings. I tried as best I cloud to explain to my buyers that there was going to be delays in shipping and offered all of them refunds. Most of the buyers still wanted the items my son deed the best he could to ship them. As far as I know everybody gut taken care of. I know the spare tire set deed not get shipped and I can not prove that a refund was given for it. I am truly sorry that you deed not get your item or a refund.

So why was there no responses to the pms later on TGO once I mentioned that the tire set wasn't shipped, and the refund was never given? Why the disappearing?

And is there another option other than me needing to call the bank in the morning to file a chargeback, which would hurt your paypal account?

It is VERY disheartening and suspicious that the situation was unresolved, yet more sales transactions are being undertaken - thus my final attitude and today's decision to get the word out on what happened... Or, you can stand by the original response of sorry the parts weren't sent, and sorry that no money was refunded, with no restitution voluntarily being made... It's up to you how you want others to see things looking at it. The payment was made on 4-29-2008 if the date helps you. Login on your paypal and reverse the payment, you can see the transaction number up above if it helps as well. It goes one HUGE step towards making things right that others can see...

I too left him alone after posting here & did not attempt to strip this seller of what little honor he may have had left. After reading his response I believe that he has no honor left to lose. Who forgets ANY detail that has had to get escalated to a claim with PayPal ?? NO ONE. That makes it clear to me that his recollection of the facts is not exaggerated - but outright lies. ( I have just re-posted the original pictures taken the day I got my package from Dave to help him remember )

This is a COMPLETE LIE. The pictures shown in the original post show EXACTLY what was received and what was returned. Dave's claim was always that I sent him a different radio; This was his response when he saw the pics posted above ( the same ones that PayPal got.)

This is a COMPLETE LIE. He attempted to let the time expire on the dispute by not responding to E-mails or thru PayPal. (There seems to be a pattern to his delayed responses and hiding from angry buyers when there is a problem.) His only previous argument was that he said the radio in the pics was not his - now it's that I sent him a box of smashed pieces...... Outrageous.

E-Bay has strict rules compared to web message boards..... I'm sure that's why he is still allowed here and not on E-Bay.

I will admit to taking your money, and not sending your parts.

I will admit to not wanting to send the refund, otherwise I would have reversed the paypal payment.

I will tell you sorry I am not willing to send you either your money or your part - hope that's good enough cause it's all you will get out of me.

And if you call me on it I will duck you every step of the way. Too bad

Actually I have done business with Dave MC twice already and he was quick to answer my questions.

I did have an issue on a part that never made it to my house, he stayed on top of it with me and eventually refunded my payment. No questions asked.

I'm sorry you guys have had issues with him, but in his defense it was pleasant for me and I would not hesitate to purchase from him again.

same experience i had, he shipped my parts asap and i had them 3 days later. Everyone has some bad experiences and by the sound of it i hope dave takes care of you and gets this settled, i would not hesitate to buy from him again.

I must chime in here in Dave's defense. I am new to the boards and responded to a recent classified add for a new in box MSD 6AL. I couldn't post a reply directly to the add because I didn't have enough posts prior to that. I did the deal through p.m's. I believe it was New years day when I said I would take it. I asked if he accepted paypal and he gave me his info. I paid immediately and his response was "I will ship ASAP". Monday Jan.5th I received the package and everything looks fine as described. just my .02 cents.

Yeah I am also in favor of Dave. I bought a Z28 emblem from him a while back. He replied quickly with pics and shipping cost. I got the item in the exact condition he stated less than a week later.
