ticekt question

to the mods:move this if you see fit because i wasn't sure what forum to post it under
i got a ticket today for 53 in a 40. i honestly do not believe i was going that fast, but i found a discrepancy in the ticket. he said he clocked me between two particular streets, but i was never between those two streets. would putting the wrong location on my ticket constitute a dismissal? please help, i cnat have any more on my record and i am already on deferred ajudication!!

best thing I can tell you to do is take pictures of where he pulled you over and where the streets are that are on the ticket and take them to court and plead not guilty. I had a cop try that with me be he said he clocked me at 62 then wrote the ticket for 65 in 35 and it was a 40 mph zone. tried to give me ticket for 30 over and said if I pled guilty in court he'd drop it to $50 but I asked for a jury trial and pled not guilty and he backed out when the case came up and it was dissmissed. Its always worth a try.

Unless you can produce an eyewitness that can say you were never on the street where the ticket was written for, just going to court and saying "I wasn't there" isn't enough to get it dismissed. If the speed limit is still 40 inside, outside, and around the place this occured, then you also don't have a chance here.

i still say best bet is to ask for a jury trial, cops don't like to face jurys

another thing to consider though, if it does to go trial, they can nail you with everything, meaning there's no chance for a reduction if thats what they usually do around you. i have 5 tickets in 2 years and every single one of mine has been reduced to a traffic violation which is a lot less than getting the actual speeding tickets. good luck, but maybe they will let ya off at trial, its worth a shot if you have enough you think to get out.

Was he wearing his hat, cause if not he would not be in complete uniform and the ticket could be thrown out.
I'd say go to court, around where I live, I hear a lot of the cops never show for the court date.

There is a book out called how to beat your traffic violation. Great, great book. I have hired a lawyer before and everything in taht book, he did to a tee. The book was under 20 dollars and the lawyer was 600 Good luck, I don't think you will have any problems though.

ok, here you go on some of the best ways to beat a ticket.

first ask for all training records the officer has on the particular radar, and also ask for calibration records. if it is a laser/lydar, there wont be much as most of them have an internal calibration check everytime it is turned on.

as far as the street it was on, that will probally turn into a minor technicallity. if it was a street a block or two over, it wont be treated as a big deal. if it was on the other side of town that could be another issue.

if the raydar they got you with was an older dopler model, then you could bring up the fact that our car is lower to the ground then most, and if there was any traffic, it could have easily picked up on a larger vehilce in either lane. If the officer was using a laser/lydar, this is invalid due to the laser sight on top of the unit. Speaking of either lane, ask if the raydar used has approching/recinding capability. what that does is it will only pick up vehicles traveling towards the patrol car, or away from the car.

take pictures of the area you were clocked at. again if the officer was using an older doopler, the larger the angle he was when he clocked you it could rasie the speed reading by a mph or two. If it was a lydar/laser it has the reverse effect and could have lowered your actuall speed.

a lot of towns the officer who wrote the ticket will not show up. If anything, for smaller traffic tickets, they have a general officer show up for all the tickets that day. another advantage.

can you tell im certified to operate doppler raydar and laser/lydar units?
