Hey everyone.... Well i just need some addvise.. Yesterday here is suffolk VA is was pouring rain down. Well i was taking a friend home, and after droping her off, i went to a stop sign. Now remember its pouring down rain. Well its finally clear enough to go, so i puch the gas, (sence i have a 6) it wasnt enough to get the car moving, Well i hit it a lil harder, and spun a tire for ohhhhhh id say about 1/100th of a second. WELL..... Mr. blue flashy lights was right behind me. I pulled over and he was giving me hell, being a complete ... well u know... anyways, all he wrote on the ticket was "reckless driving general jusisdiction" and my court date is next week.. What do i do, everyone says that sence its "reckless" it wont just be dismissed.

Is it possiable its just b/c i am 18 and drive a red firebird?? If so can i sue or anyhting for that... i dont want or need this **** right now.... thanks for everyones help.

 

Man what a d!ck. I am not sure of any way you can get out of it unless the cop doesn't show up. Plead your case though. You know tell the judge what you were driveing, make sure he/she understands its a rear wheel drive sports car and that it was raining that day. Also make mention of the fact that once they spun you let off in an effort to regain traction. This will be alot easier too if you have no prior tickets. Man that cop is being an ***, definantly because of your age and car, but you unfortunatly can't say that.

 

what you gotta do is plead "not Guilty" to the ticket. then you will be assigned a new court date to talk to the town prosecuter. when you go to the town procecuter explain that it was raining hard and the roads were slippery and after making a complete stop at the stop sign you hit the gas and accidently spun the tires a bit because of the rain. the prosecuter will more than likely reduce your ticket to a parking ticket and send you to driving school. yea its a pain in the *** but it beats points on your record and probably will cost you a bit less this way

 

your citation should have a state statute number or local ordinance number on it. get online and look up that state law or go to your local library and look it up. find out what the law actually states, plead not guilty and argue your case based on the facts, not only the situation but what the law states.

The same thing happened to me, tire broke free and spun a bit, cop wrote me for careless driving. I went to court and it was dismissed because what I did didnt qualify as careless driving as the law defines it.

 

thanks alot guys, i talked to a few people one is my mothers friend, she has a daughter that has about 100000 tickets and they told me that she had almost 100% the same situation and they have a lawyer who got it down to parking with no classes but he costs like 350.... i think im gonna go with that... it sounds a lot easier, and i guess ill write more when its all over with.. let everyone know how it goes.. lol

Now i cant wait till it get the 91 on the road... only like double the torque... so how hard is it NOT to spin a tire in the rain?? LoL Might as well keep it off the road for an aditional 6 months and make it a 335 stroker... what ya think? then i get almost 300 hp... Yay... well bye bye fuel economy tho.. lol to many decisions and TO MANY ******* cops....

 

Wait till you get something with more power. If I even breathe on the gas in the rain the tires spin. No flooring it to accelerate below 50 in the bird on wet ground. Im waiting for an A$$ hole cop to pull me over for accidently spinning them with my mom in the car. That would be so great.

There is your problem. I got a ticket but I was guilt of it, did it rite in front of a cop, on dry roads ...I know I know, I didnt see him and it was at the entrance to carlisle.

But anyway, fighting it depends how aggressive you wanna get. You can go, talk to the cop before hand, and he may lower it, that is your best bet to start out with, Judge your next action on him.

I'd check the laws and see them.

You could argue as a last ditch back up that it was pouring and he could not have possibly told if you REALLY spun them due to limited visibility and if you spun them enough to definitivily know they spun that he probobly would have taken your license.

My mom is a taxidermist, she could mount it for you. LoL When i hit a deer, im getting her too... im thinking im gonna get it to look really messed up with a firebird logo on the side of it.. then maybe a terminator name tag just for you... LOL

in my situation the cop wrote for careless after my tire spun for a sec at a light. in florida the statute for careless driving indicates that the driver is operating the vehicle in a manner that is dangerous to themselves or other drivers. I cross examined the cop in court, did my car fishtail? no, did it move in any direction other than a straight, normal course? no did I veer into another lane or break the speed limit? no...ticket dismissed. now if he had written me a ticket under the street racing statute for exhibition of acceleration, that would have been tough

I got jerked around by cops with an attitude too many times when I was younger to take their **** now. Dont get me wrong, I've been pulled over by a lot of cool cops, who had me nailed and knew it and let me go, always be cool with them even when they arent cool with you.

 

From your title, if it is a guy sue him, that's molestation, if it's a woman cop go for it.


Kiddin though, that's BS in the rain, our cars don't hook with a damn in the rain.

Cops can abuse their power and there isn't much you can do about it..........try sueing the police department....HAHA......you could get 5 feet in a car without a ticket......

remember Rodney King, he made a big deal.............they waited for the media to die down,.......and bam he's back in jail, althought no one really cares so the cops are fully able to do what they want..........

 

I believe around here, you can't get a ticket if the "chirp" is under so many seconds. May want to check into that.

 

You can't do too much about the abuse of power... but you can make the cop damned uncomfortable if you have a concealed weapons permit (just the permit) when they pull you over.... "What type of piece are you carring tonight Mr. ..."

 

I got nailed once for a similar situation. I was driving my 82 Z28 with CFI and posi, on a rainy night, leaving a bank drive up across the street from a police station in NJ. While pulling into the street, I gave the car gas, nothing. I gave it more gas, nothing. I rev the engine a little more to get going and do a 180 right in front of a cop. He pulls me over and writes me up. I went to court with the paperwork showing my tranny was slipping and that it was repaired after the ticket was issued. The judge said he didn't think I would do something like that on purpose, in front of the police station and especially in front of a cop, but he granted the ticket anyway. I think I got hit for careless driving and 3 points at 18 in a red Z!

The morale of the story is, they don't care if it's raining, faulty equipment or whatever. They only want your money!

 

I got pulled over for spinning my tires once and given a warning. He called it excessive acceleration.

He probably pulled me over because it was dry on a sticky road and I held the throttle down all the way through first gear. He heard me from around the corner and down a street.

Good thing he didnt see the celica I raced I beat it so bad he probably didnt think it was racing though

 

excessive acceleration isn't a law in every state. texas is the only state i know that has it, but i am sure theres others. i know tennessee doesn't have it.

when i spun my tires (no wet roads) and the cop pulled me over, (this is the 2nd day i had my firebird) and i told him that i had just gotten the car and that i wasn't an expert driver and that i had no idea how much power the car had. he left me off with a warning

I got a ticket for making a U turn $171 and 4 points on my license!
my question to this ticket is why the hell is there a left turn lane when there is no where to turn?

I had only had my Z28 ('83) for about 4 hours when i got pulled over for spinning my tires, hehehe.... get this.... on ICE !!!

Is this not the stupidest thing you have ever heard?! well, if not, you'll love this... the cop slammed on the brakes and was LESS THAN 1" FROM MY CAR! He slid at least 6 feet and was partly sideways.

Now, tell me... who should be giving the warning to who here?!

Cops are *******s. Here is more story.

I droped off my friend, its snowing out, the corner is completly ICE/snow. After I dropped him off i went around the corner and my back end slid out (i didnt punch it, it wasn't intensional).
SOMONE phoned the copz on me and gave them my plate#!
Copz came to my house and just bitched at me about it.
I'm like it wasn't intensional, I need new tires.
The fagg0t cop: OHHHH so ur admiting to driving with out proper equipment!
Me:*thinks to himself: I didnt know it was against the law to have non-snow tires/barely ne tread*

Some people are just *******s.

 

Some states do have tread requirements. Some states like Oregon require snow chains to be carried during the winter.
